RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
APPROVING CHANGE ORDER AND APPROPRIATING ADDITIONAL FUNDS
TO COMPENSATE INFRASTRUCTURE MANAGEMENT SERVICES (IMS)
FOR THE TESTING OF CITY STREETS
The City Council of the City of Chula Vista does hereby resolve as
follows:
WHEREAS, on January 10, 1989, Council approved Resolution 13920
enabling the City to enter into an agreement with Infrastructure Management
Services {IMS} for the testing of City streets Phase ItI, and
WHEREAS, the streets to be tested in this phase are located in
several areas east of 1-805 and in an area south of "L" Street between Hill top
Drive and 1-805, and
WHEREAS, when the project was completed and the data received, it
was determined that the funds which had been appropriated for the project were
insufficient to fully cover the services rendered by IMS, and
WHEREAS, staff recommends that Council authorize a change order and
appropriate additional funds in the amount of $3,628 to cover the full cost of
consultant services for the testing of City streets.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Chula Vista does hereby approve a change order and appropriate additional
funds in the amount of $3,628 from the unappropriated fund balance of the Gas
Tax Fund to Account #250-2501-ST414.

FIRST AMENDMENT TO AGREEMENT FOR ENGINEERING STUDY
THIS FIRST AMENDMENT TO AGREEMENT, made and entered into
CHULA I A, CALIFORNIA, a municipal corporation, hereinafter
referred to as "City" and INFRASTRUCTURE MANAGEMENT SERVICES
(IMS), a Illinois partnership, 3350 Salt Creek Lane, Suite 117,
Arlington Heights, Illinois 60005, hereinafter referred to as
· Consultant"; for increases in compensation for services
performed in connection with the City of Chula Vista pavement
management system;
WHEREAS, on January 10, 1989, the City Council approved
Resolution No. 13920 approving an agreement with Consultant for
the testing of City streets Phase III, and
WHEREAS, when the project was completed and the data
received, it was determined that the funds which had been
appropriated for the project were insufficient to fully cover the
services rendered by Consultant since 364 tests in excess of
those originally estimated to be tested were actually performed,
and
WHEREAS, the agreement requires the payment of $25 per
test for the number of tests actually performed not just those
estimated and it is, therefore, necessary and desirable to amend
the agreement to increase the cap on the maximum amount payable
under the agreement to pay for the services actually performed.
WITNESSETH:
THAT IN CONSIDERATION OF THESE PREMISES AND THE MUTUAL
COVENANTS SET FORTH HEREIN, the parties agree:
1. The dollar amount set forth as the contract maximum
in Paragraph 1 under THE CITY AGREES is increased from $50,800 to
$58,800.
2. All other terms and conditions of the agreement
remain unchanged except as specified herein.
IN WITNESS WHEREOF, the parties hereto have executed
this Firs.t Amendment to Agreement as of the day and year first
written above.
