RESOLUTION NO. 1135-A ,
RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CHULA VISTA ESTABLISHING HOLIDAYS
FOR CITY PERSONNEL IN THE CLASSIFIED
, SERVICE
THE CITY COUNCIL OF THE CITY OF CHULA VISTA,DOES HEREBY
RESOLVE AS FOLLOWS:
That, upon the recommendation of the Civil Service
Commission of tho` Citrof Chula Vista, the following policies
are hereby adopted by the° .City Council of 'said .City to govern
holidays for personnel of this City in the classified service,
effective July 1st, 1950:
Holidays include all .holidays within the
meaning//of Section 10 of the Political Code
as Aow�`'hereafter amended, on which holidays
public offices are not required to be open
to the public. Employees may be entitled
to the following holidays: ' 1/1, 2/12, 2/22,
5/30, 7/4, 1st Monday in September, '9/9, ., .
10/12, 11/11; 12/25, every day on which an
election is held, throughout the State, and
every day appointed by the Governor of this
State for a public 'fast, Thanksgiving, or
holiday. When a day herein listed falls on
a Sunday, the following Monday, shall be
deemed ro•)be the holiday in lieu of ,the day
• observed. ' Any employee who may be required
to work on any' of the holidays herein men-
tioned,- and who does work on any ofLsaid
. holidays, shall be granted equivalent time
off with pay for such work, provided such
time off can be granted within the departmentTs
° budget allowance.
It is the intent °.of this Resolution to provide
that all 'employees will •receive the same amount
of time off with" pay for holidays as -is received
by employees working the standard 5 day, 40
hour, Monday to Friday work week, provided such '
time off can be granted within the department's
budget allowances.
ADOPTED, SIGNED AND APPROVED this iVth day of June, 1950.

OPINION
SUBJECT: WHEN A HOLIDAY FALLS ON SATURDAY, IS THE SAME A •
HOLIDAY. FOR ALL DEPARTMENTS IN THE CITY OF CHULA
VISTA?
•
Resolution No. 1135-A of the Resolutions of the City
of Chula Vista provides and designates certain holidays to
which employees shall be entitled, February 12th being one of
the designated holidays. It is further stated in said resolu-
tion as follows:
"When a `day ,herein'listed falls on' a Sunday,
the following Monday shall be`,'deemed to be the •
holiday in lieu of the day observed."
The resolution further provides:
' . "It is the 'intent of this Resolution topro-

The 'resoltition does hot state that when a holiday falls
on a Saturday that the, following Monday or the preceding Friday
or 'an3r' other day shall •be deemed to be a holiday' in lieu of the
\day observed. P'
It is obvious that emplo3rees'worrc±n 1 standard' 5 'daY�
40 hour week, .Monday through Friday work week would not obtain
the benefit Of this holiday falling on Saturday.
Therefore,' any employee working on Saturday, Lincoln's
Birthday, Februark 12th would receive more time off with pay if
such holiday was observed by said employee, than any other em-

ployee of said city. This apparently is not the' intent of
said resolution.- '

CONCLUSION: When a holiday falls on a Saturday, no
employee' shaf9.,'receive time off with gay for said holiday in
said cit3`.
