HomeMy WebLinkAboutReso 1990-15482 RESOLUTION NO. 15482 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA, ORDERING CERTAIN CHANGES AND MODIFICATIONS TO THE ENGINEER'S "REPORT" IN A SPECIAL ASSESSMENT DISTRICT WHEREAS, the City Council of the City of Chula Vista, California, has previously adopted its Resolution of Intention pursuant to the provisions of the "Municipal Improvement Act of 1913", being Division 12 of the Streets and Highways Code of the State of California, for the construction and/or acquisition of certain works of improvement in a special assessment district known and designated as ASSESSMENT DISTRICT NO. 88-2 (OTAY LAKES ROAD) (hereinafter referred to as the "Assessment District"); and WHEREAS, based upon the presentation and recommendations of staff and available documentation, it now appears that the changes and modifications as set forth in the amended assessment roll increasing assessments, as presented herein, should be approved and ordered to be done; and, WHEREAS, there has also been submitted a proposed amended BOUNDARY MAP showing the addition of a parcel previously omitted that should be included within the boundaries of the proposed Assessment District; and, WHEREAS, the property owner has consented to the inclusion of said parcel and the modification and increase in the assessments by executing a written Consent and Waiver to said change. NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: SECTION 1: That the above recitals are all true and correct. SECTION 2: That the proposed amended BOUNDARY MAP, as submitted, is hereby approved and adopted. A copy of said amended boundary map shall, immediately upon adoption of this Resolution, be filed in the Office of the County Recorder. SECTION 3: That the changes and modifications as set forth in the final assessment roll and Engineer's "Report" as herewith submitted are hereby ordered and authorized to be made, and specifically as hereinafter set forth: A. Order modifications and amendments to boundaries to include parcel previously omitted. 8. Authorize and approve increase in assessments to reflect benefits received. Resolution No. 15482 Page 2 For all particulars to the above changes and/or any other changes, reference is made to said "Report" as herein approved, a copy of which shall remain on file with the transcript of these proceedings and open for public inspection. SECTION 4: That the Engineer's "Report", the Assessment Roll, and all related documentation, as so modified, are for the best interests of the property owners within the Assessment District, and said assessment, as modified, is in accordance with the benefits received, and the "Report", as herein modified and amended, shall stand as the "Report" for all subsequent proceedings relating to this Assessment District. SECTION 5: That the executed property owner CONSENT AND WAIVER, as submitted, shall be filed in the Office of the City Clerk and remain open for public inspection.
