The growth in park use has created a greater problem with broken glass,
bringing an increase in safety hazard to park patrons. To combat the problem,
it is considered necessary to prohibit glass beverage containers in the City' s
parks.
RECOMMENDATION: Council place the Ordinance on first reading.

As the use of our parks continues to grow, there is a concomitant 1ncreae I. {
the amount of broken glass left behind. This debris, mostly shattered
beverage bottles, is presenting greater danger to park patrons, especially
children, as evidenced by complaints from concerned parents. The
proliferation of shattered glass is not restricted to the parking areas, but
is found virtually everywhere, including grassy areas and in the sand under
playground equipment. Although much of the breakage is done maliciously by
youth gangs drinking in the parks after dark, children are often tempted to
break bottles discarded by picnickers.
Not only in the City' s exposure to lawsuit increased by the presence of broken
glass, the cost of park maintenance is also directly affected. Cleanup of
glass has become a daily ritual and is more time consuming than general
litter, since it often must be sifted from the sandy areas.
The City of San Diego, when faced with the same problem, amended their litter
law earlier this year to prohibit glass beverage containers in their parks.
Similarly, cities all over the country are enacting legislation to control the
problem.
Adoption of the Ordinance, with proper enforcement, will result in cleaner
parks, less danger of severe injury to park patrons and a reduction in park
maintenance problems.
The Park Ranger and maintenance personnel will be instructed to advise those
with glass beverage containers of the Ordinance. If they receive no
cooperation, they will not become involved in a confrontation, but will report
the offenders to the police for enforcement. It is recognized that total
enforcement may not be possible, particularly at night. It is anticipated,
however, with proper signage and news releases, the use of glass containers in
the parks will be significantly reduced.
FISCAL IMPACT: Approximately $450 to erect signs will be funded from
Account 100-1520-5362.
