City Manager (4/5ths Vote: Yes NoX ) REVIEWED BY: City Manager ( On June 21 , 1983, the City Council adopted Resolution No. 11287 which extended the time for execution of new Memoranda of Understanding for FY 1983-84 with all bargaining units to September 1 , 1983. Negotiations are underway with each of the four bargaining units but it is now apparent that final agreements will not be reached with any of the units before August 31 , 1983. RECOMMENDATION: Adopt resolution. BOARDS/COMMISSIONS RECOMMENDATION: N.A. DISCUSSION: Action taken by the City Council on June 21 , 1983 provided that salary adjustments, if any, for both represented and unrepresented employees of the City would be retroactive to the first pay period in FY 1983-84 if new Memoranda of Understanding were executed on or before September 1 , 1983. The negotiation process is at times slow and difficult. Such is the case this year in attempting to work out the details of new Memoranda of Understanding with four different bargaining units. It is now apparent that the September 1 deadline cannot be attained and therefore it is felt that a new date of October 1 , 1983 should be allowed in order to accommodate a reasonable period of time that is needed to reach final agreement with all four units. It is entirely possible, and likely, that agreements can be reached with some of the units prior to the October 1 date. However, an earlier date for some of the units probably could not be met. Adoption of the resolution would also extend the current MOU's until October 1 , 1983. FISCAL IMPACT: N.A. PREVO ieneral Manager Honorable Mayor and Councilmembers -0 City Council City of Chula Vista "1 276 Fourth Avenue MI>, 0 Chula Vista, CA 92010 Dear Councilmembers: The Chula Vista Employees' Association, affiliated with San Diego County Employees' Association, received a copy of Council Resolution No. 11287, approved at your meeting of June 21, 1983, extending the life of the 1982-83 Memorandum of Understanding, and assuring retroactivity of negotiated benefits, salaries, and working conditions in any new contract to the first pay period in Fiscal Year 1983-84, provided said new Memorandum must be executed on or before September 1, 1983. Chula Vista Employees' Association and City representatives have held several meet-and-confer sessions to discuss the 1983-84 M.O.A. over the past weeks, and have scheduled additional meetings; progress toward mutual agreement is being made; however, CVEA may not have, between this date and September 1, 1983, sufficient, reasonable time within which to finalize and execute said Agreement in order to meet the deadline spelled out in your Resolution No. 11287. Therefore, in that it is both mutually beneficial and desirous of the parties to continue to meet in good faith, and being cognizant of the need for resolution within a reasonable time of all outstanding issues in a forum of mutual trust, we would respectfully request your honorable Council extend the end date contained in Resolution No. 11287 from September 1, 1983 to September 15, 1983, by amendment of said Resolution.
