HomeMy WebLinkAboutAgenda Statement 1983/08/23 Item 9 COUNCIL AGENDA STATEMENT 9 Item Meeting Date 8/23/83 ITEM TITLE: Resolution //3 Approving Encroachment Permit No. PE019, Bonita Ponderosa Mod 1 Homes sign SUBMITTED BY: City Engineer (4/5ths Vote: Yes No x ) REVIEWED BY: City Manager, In May of 1980, the City Council approved an encroachment permit to allow Ponderosa Homes to erect a sign within the City's open space. One of the conditions of approval was that the permit would expire upon the date that the City assumed responsibility of the open space. Recently, Ponderosa Homes was notified that the City is presently contracting with a landscaping firm to maintain this open space and that the sign was to be removed. On June 29, 1983, this department reviewed a letter from Harvey & Company, Outdoor Advertising, acting as agent for Ponderosa Homes, requesting permission to maintain the sign in its present location for an additional two years. RECOMMENDATION: That the Council approve a temporary encroachment permit and authorize the City Engineer to issue said permit. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: Early in 1980, Ponderosa Homes applied for an encroachment permit to place a model homes sign within the City' s Open Space Lot No. 253 in Rancho Robinhood III Subdivision. At that time, this open space landscaping was not being maintained by the City. By Resolution No. 10049, adopted by Council at its meeting on May 1, 1980, this encroachment permit request was approved. One of the conditions added to the permit was that the permit would expire upon the City' s assumption of the open space maintenance. The City has since assumed maintenance of this portion of open space in Rancho Robinhood III. By letter dated May 16, 1983, Ponderosa Homes was notified of the expiration of the permit and directed to remove the sign. They responded with a letter requesting renewal of the permit. They have paid the required $200 fee in accordance with Ordinance 1836. The sign has been in place for over three years and has not caused any problems. Ponderosa Homes has maintained and will continue to maintain the sign and the landscaping immediately surrounding the sign. The existence of this sign is very beneficial to Ponderosa Homes as they are still selling homes within the subdivision. The sign is causing us no problems in our maintenance efforts. Page 2, Item 9 Meeting Date 8/23/83 Neither the City Landscape Architect or the Director of Parks and Recreation have any objections to the extension of the permit. It is recommended that the encroachment permit be approved and limited to a two-year period, at which time the sign will be removed or another extension applied for.
