ie City currently has a contract with Duane Rogers, Personal Assistance Services, to
'ovide an Employee Assistance Program for City employees. The contract under which
its service is provided is up for renewal .
:COMMENDATION: That Council extend the contract with the addition of a hold harmless
ause, designation of contractor as an "independent contractor" , and a requirement for
mtractor to have insurance.
IARD/COMMISSION RECOMMENDATION: N/A
SCUSSION: The Employee Assistance Program has been in existence for almost
years and it appears that it is meeting, or actually surpassing its objectives.
le original objectives were to reach 1% of the total workforce, however, recent reports
iow that almost 11% of our employees have used the program.
reviewing the contract it was noted that three items were not included that are
;eful to the City. These three items, II STATUS AS AN INDEPENDENT CONTRACTOR,
INDEMNIFICATION, and VI INSURANCE, have been added with Mr. Rogers consent.
SCAL IMPACT: $5,400 has been allocated in the 1983-1984 budget for the
iployee Assistance Program. This amount reflects an increase over last year of
XO0 or 8%, due to inflation in the cost of operations. Mr. Rogers did not receive
uy increase during the second year of his contract.

I HEREBY CERTIFY that the indebtedness and obligation
to be incurred by the contract or agreement authorized by the
attached resolution can be incurred without the violation of any
of the provisions of the Charter of the City of Chula Vista, or
the Constitution or the laws of the State of California, that
sufficient monies have been appropriated for the purpose of said
contract, that sufficient monies to meet the obligations of the
contract are actually in the Treasury, or are anticipated to come
into the Treasury to the credit of the appropriation from which
the same are to be drawn, and that said monies now actually in
the Treasury, together with the monies anticipated to come into
the Treasury, to the credit of said appropriation are otherwise
unencumbered.
