HomeMy WebLinkAboutReso 1990-15463RESOLUTION NO. 15463 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING PCC-90-21 ESTABLISHING A BOARD AND CARE FACILITY FOR INDIVIDUALS WITH MILD MENTAL DISORDERS AT 551 "D" STREET The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the proposal is to establish a board and care facility serving 49 individuals {primarily veterans) with mild mental disorders within an existing apartment building at 551 "D" Street in the R-3 zone, and WHEREAS, the Environmental Review Coordinator conducted an Initial Study, IS-90-25, of potential environmental impacts associated with the implementation of the project and concluded that there would be no significant environmental impacts, and recommends adoption of the Negative Declaration issued on IS-gO-25,, and recommend PCC-90-?I. WHEREAS, on December 13, 1989, the Planning Commission voted 6-0 to that Council approve the request in accordance with Resolution NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve PCC-90-21 to establish a board and care facility for individuals with mild mental disorders at 551 "D" Street based on the following findings: 1. That the proposed use at the location is necessary or desirable to provide a service or facility which will contribute to the general well being of the neighborhood or the community. The use would provide shelter, food, training and counseling for disturbed veterans in an R-3 area within convenient walking distance of the Broadway commercial strip. 2. That such use will not under the circumstances of the particular case, be detrimental to the health, safety or general welfare of persons residing or working in the vicinity or injurious to property or improvements in the vicinity. The residents will be supervised on-site 24 hours a day, and also will be involved in job training, work and social programs on a daily basis. The use as conditioned will provide adequate on-site parking and recreation areas. Resolution No. 15463 Page 2 3. That the proposed use will comply with the regulations and conditions specified in the code for such use. The use shall be required to comply with all applicable codes, conditions and regulations prior to the issuance of permits and on a continuing basis thereafter. 4. That the granting of this conditional use permit will not adversely affect the general plan of the City or the adopted plan of any government agency. The use is consistent with applicable City policies upon the issuance of this permit. BE IT FURTHER RESOLVED that said project is subject to the following conditions: A landscape and irrigation plan and ~all/fencing program shall be submitted for the enti re property subject to review and approval of the Director of Planning with the intent to enhance the overall appearance of the property as well as to screen and buffer the outdoor activity and parking areas. The plan shall provide for eight off-street parking spaces and shall include additional landscape planting around and within the common patio and parking areas, as well as along the street frontages, including any necessary enhancement of existing landscaped areas. Fencing and/or walls shall be carried around the entire perimeter of the site excluding the parking and front setback areas. The common patio area shall be enclosed by a 6 foot high decorative fence or solid masonry wall. The office area, live-in counselor quarters, guest parking area and primary entrance-exit shall be located on the southerly portion of the property adjacent to "D" Street. The employee parking area as well as secondary entrance shall be located on the northerly portion of the property adjacent to Casselman Street. Check-ins and check-outs, other than arrivals and departures in the facility van, shall occur at the main entrance on "D" Street. Residents shall not be allowed to loiter off-site or outside the patio area on-site. Resolution No. 15463 Page 3 The use shall comply with the information outlined in the application and supplemental materials submitted by the applicant, including numbers of residents and staff, hours, programs, supervision, transportation and so on. Failure to comply with these parameters or the conditions of approval, complaints from surrounding residents, or failure to properly maintain the building and grounds shall constitute grounds for review and possible revocation of the permit. An agreement shall be prepared and recorded binding the current property owner and any successors in interest to comply with the City's parking and other applicable standards should the property revert to apartment use. This permit represents 1 and use authorization only. The use shall comply with all applicable building and housing and fire requirements and regulations prior to the issuance of any development or occupancy permits. To the extent permitted by state 1 aw, the residents shall be limited to veterans. The facility will conduct a thorough background check of each potential resident and shall deny residency to any individual with a history of aggressive or sexually deviant behavior or the use of illicit drugs. This restriction shall be clearly stated in the facilities admissions policies and procedures. The term of this conditional use permit shall be for eighteen (18) months at which time, the City Council shall review the operation and may extend the term or allow the conditional use permit to expire.
