Pacific Scenes, Inc. , the developer of Charter Point Subdivision Units 1 , 2,
and 3, has petitioned for formation of an Open Space Maintenance District in
accordance with a condition of approval of the Tentative Subdivision Map. The
land occupied by Charter Point Subdivision is presently included in Open Space
Maintenance District No. 1 as three undeveloped parcels. Because the Charter
Point open space will he maintained by the homeowners association the area
needs to he removed from District 1 . A new district which will include only
Charter Point needs to be formed to assure that the open space will he
maintained. The separate owners will not he assessed unless the homeowners
association does not properly maintain the open space.
On June 21 , 1983, Council set July 12, 1983, as the date for a public hearing
on the proposed modification and formation of the respective open space
maintenance districts.
RECOMMENDATION: That Council :
1 . Conduct the public hearing.
2. Adopt a resolution modifying Open Space Maintenance District No. 1 by
withdrawing the land occupied by Charter Point Subdivision, and forming
Open Space Maintenance District No. 12 for Charter Point Subdivision.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
A condition of approval of the Tentative Map for Charter Point Subdivision
required the developer to petition for the formation of an open space
maintenance district. That condition of approval stipulated that assessments
would not be imposed unless the designated open spaces (Lots A, B, and C)
within the subdivision are not maintained satisfactorily by the homeowners

association. Should the association fail to properly maintain these open
spaces, City Council could accept the irrevocable offer of dedication,
authorize staff to obtain bids for maintenance of the open space and impose
fees to defray the contract cost for said maintenance.
Charter Point Subdivision presently is included within Open Space Maintenance
District No. 1 and is assessed as undeveloped land. Since the Charter Point
Subdivision is being developed, it is no longer appropriate nor equitable for
Charter Point to be considered as undeveloped parcels. Accordingly, the
Charter Point parcels need to be withdrawn from Open Space Maintenance
District No. 1 and formed into an open space maintenance district exclusive to
Charter Point Subdivision.
The district should be formed but no assessments made unless the homeowners
association does not properly maintain the open space. In that event, the
City will assume maintenance responsibility from the homeowners association
and assess the appropriate fees to defray maintenance costs for Open Space
Maintenance District No. 12. Those costs are estimated at $43 per year per
dwelling unit based upon an estimated annual cost of $3,600 per acre for
landscaped areas and $200 per acre for natural open space areas.
Withdrawing the three units of Charter Point from District No. 1 would result
in an increase to the annual charge of approximately $0.38 to most of the
remaining properties. If Charter Point is not withdrawn, then the slopes
within Charter Point should be maintained by District No. 1 with contributions
from Charter Point units. This option would therefore increase the
assessments on the parcels in District No. 1 by $0.80 per year, or an increase
of $0.42 over the option of deleting Charter Point from District 1 .
The boundaries for the proposed Open Space Maintenance District No. 12 are the
same as the subdivision boundaries for Charter Point Units 1 , 2, and 3, which
includes 274 residential lots. Exhibit "A" shows the proposed boundaries for
Open Space Maintenance District No. 12 and the benefitting properties.
Exhibit "B" shows modified boundaries for Open Space Maintenance District
No. 1.
