Staff is recommending that City Ordinance 2 .60 be amended as it relates
to the processing of found bicycles. Specifically, when bicycles are
found that do not have serial numbers they will be sold at auction if not
claimed by their lawful owner within 90 days . Staff is also recommending
another addition to this Ordinance which would allow staff to destroy found
property that is unclaimed by the lawful owner or not sold at public
auction. As it now stands if unclaimed or not sold we must continue to
store this property.
RECOMMENDATION: That Council place Ordinance on first reading

DISCUSSION:
want to prevent the possibility of persons stealing bicycles with no
lentifying serial numbers from legal owners who have not licensed or
serialized them at purchase and then be able to legally claim them after
90 days as their own.
Government Code Section 50050 and Civil Code Section 2080 .4 identifies the
procedure and requirements for claiming ownership of found property. A
subsection of these laws gives local jurisdictions the authority to dispose
of property coming under its control upon the passage of a local ordinance.
Therefore staff is recommending that Section 2.60 .150 be amended to include
Section C that would allow the City to auction unclaimed bicycles that are
not claimed within 90 days . Staff is also recommending the enactment of
Section 2.60 .095 which would allow for the destruction of found property
that is not claimed and is not sold at public auction.
