As part of the development of the property at the southerly terminus of Las
Flores Drive on the east side, the owner was required to apply to the City for
vacation of the public alley along the westerly property line (see attached
Exhibit "A") . The Council , by adoption of Resolution No. 12380, set a public
hearing for March 11 , 1986, to consider the proposed vacation.
RECOMMENDATION: That the Council hold the subject public hearing and adopt
a resolution ordering the vacation of the subject portion of public alley.

DISCUSSION:
L & V Investments submitted a tentative parcel map to the City in September of
1985. They proposed to divide two existing parcels into four parcels. These
properties lie just north of "E" Street between Minot Avenue and Las Flores
Drive ( see Exhibit "A"). Among the conditions of approval of this map is the
requirement that the owners submit a petition to the City to vacate the public
alley located along the westerly portion of the parcels.
On January 17, 1986, application by L & V Investments was submitted along with
the prescribed application fee. At its meeting of February 18, 1986, the
Council adopted the Resolution of Intention to vacate the alley and set the
public hearing in accordance with Part 3, Chapter 3, Section 8320 of the
California Streets and Highways Code.
The Planning Department was contacted regarding its concerns about vacating
the alley and has responded, stating that staff had no objections. All
utility companies have been advised of the intention to vacate. All have
responded stating they do not object to the vacation with the exception of the
Sweetwater Authority. It has requested that an easement covering the entire
area being vacated be reserved for any facilities the Authority may need to
install in the future. The City will reserve the entire area for its existing
sewer and storm drain facilities.

It has been determined that this portion of alley is no longer needed for
access to any of the adjacent properties. The alley was originally dedicated
on the Rosebank Subdivision Map No. 1304 in 1911 . It ran in a north-south
direction from "E" Street north to the subdivision boundary. Most of this
alley has been dedicated as Las Flores Drive. The portion proposed to be
vacated is south of the southerly cul-de-sac of Las Flores. After the parcel
map submitted by L & V Investments is complete, all properties will have
access directly off Las Flores Drive. Therefore, there will be no land-locked
parcels.
The alley portion from "E" Street to a point 64 feet northerly was vacated in
1959 by Council Resolution No. 2237.
Notice of this public hearing has been accomplished including publishing in
the Star News; through Postal Service to those property owners within 300 feet
of the subject alley and signs posted by this department on the site.
