Govt. Code Section 56470(h) ) c SUBMITTED BY: Director of Parks and Recreation REVIEWED BY: City Manager9 (4/5ths Vote: Yes No X ) This is a request to accept the deed that transfers the two park properties, Landerbach Park and a .7 acre undeveloped parcel across from the Woodlawn Park Center, from the County to the City in conjunction with the Montgomery Annexation. RECOMMENDATION: Adopt the attached resolution; (a) accepting the transfer of two park properties, (Parcels No. 75-0424A and 77-0675A) , to the City of Chula Vista, and; (b) authorize the Mayor to execute the acceptance statement and, (c) directing the City Clerk to have the deed recorded. BOARDS/COMMISSIONS RECOMMENDATION: Not appl icbl e. DISCUSSION: On February 14, 1986, a County Board of Supervisors letter and resolution, which approved the conveyance of the above referenced property to the City of Chula Vista, was forwarded to the Parks and Recreation Department. Also, the original Deed was forwarded. The City must now accept the conveying instrument, fill out the acceptance statement, and record the Deed to complete the transaction on the transfer of these parcels. KAUFMAN, ector (Acting) Department of General Services RPM:LLF:sjm Enclosures ARCHITECTURE & ENGINEERING COMMUNICATIONS REAL PROPERTY MANAGEMENT FLEET OPERATIONS FACILITIES SERVICES No.43 TUESDAY, FEBRURY 11 , 1986 RESOLUTION TRANSFERRING COUNTY PARKS TO INCORPORATED CITY (PURSUANT TO CALIFORNIA GOVERNMENT CODE SECTION 56470(h) On motion of Supervisor Eckert , seconded by Supervisor Bilbray , the following resolution is adopted: WHEREAS, the County of San Diego owns the park properties described in Exhibit "A" attached, known as follows: Lauderbach Park Parcel No. 75-0424A Woodlawn Park Center Parcel No. 77-0675A WHEREAS, these park properties are located in the Montgomery area of the City of Chula Vista, and, WHEREAS, the Montgomery Area is being reorganized under the City of Chula Vista and, WHEREAS, the Local Agency Formation Commission's proposed terms and conditions of the reorganization indicates, that the Lauderbach Park and Woodlawn Park Center are to be transferred to the City of Chula Vista under Government Code Section 56470(h) NOW THEREFORE, BE IT RESOLVED AND ORDERED AS FOLLOWS: 1. This Board finds that these parks are local in character because of their location, size and population which they serve. 2. The transfer of these parks to the City of Chula Vista , is in accordance with the terms of the Local Agency Formation Commission's proposed terms and conditions of the reorganization of the Montgomery Area. 3. Transfer of these properties to the City of Chula Vista is not subject to the environmental impact evaluation process, because it is an ownership transfer only and will not have any effect on the environment. 4. The Clerk of the Board of Supervisors is hereby authorized to execute the Grant Deed to transfer the properties to the City of Chula Vista and to thereafter forward the deed to the City of Chula Vista for their acceptance and recordation. Lauderbach Park contains approximately 3.90 acres and Woodlawn Park Center contains approximately .70 acres. An area of the County adjacent to the City of Chula Vista, known as the Montgomery Area, is being reorganized under the City of Chula Vista, effective December 31, 1985. It is necessary under the Local Agency Formation Commission's proposed terms and conditions of the reorganization to transfer the park lands therein to the City of Chula Vista under Government Code Section 56470(h) . In conjunction with the proposed terms and conditions of this reorganization, it is necessary to transfer the park lands in this area to the City of Chula Vista in accordance with Government Code Section 56470(h) .
