HomeMy WebLinkAboutAgenda Statement 1986/03/25 Item 8 COUNCIL AGENDA STATEMENT Item 8 Meeting Date 3/25/86 ITEM TITLE: Resolution 1 a 7//02-' Approving amendments to agreement numbers 11-0094A/2 and 11-0116A/1 between the City of Chula Vista and the State of California for acquisition of right-of-way and utility relocation for I-5/54 interchange and Tidelands Avenue interconnect SUBMITTED BY: Director of Public Works/City Engineer ()FLY REVIEWED BY: City Manager 0 (4/5ths Vote: Yes No X ) In the early 1970's Chula Vista deposited $100,000 with CalTrans for the purpose of acquiring right-of-way and engineering costs for the Tidelands Avenue ramps from State Route 54. The current project is under construction and the Tidelands Avenue ramps are not a part of the project. The proposed amendments to the agreements with the State terminates the agreement and provides for the refunding of the City's $100,000 deposit. RECOMMENDATION: That Council approve the resolution amending agreement numbers 11-0094A/2 and 11-0116A/1 between the City and the State of California. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: On April 18, 1972, Council by Resolution No. 6401 approved an agreement (11-0094A/2) between the City and the State of California for acquisition of right-of-way and utility relocation for 1-5/54 interchange and Tidelands Avenue interconnect. This agreement obligated the City to deposit $100,000 with the State to cover ithhthe estimated onCJunes19,e1973t(check) #59250)t This and was amount was deposited to Account No. 6100-148-2 (Gas Tax). However, on October 16, 1973, Council by Resolution No. 7403 approved an amendment (agreement #11-0116A/1 ) to the April 18, 1972 agreement. This amendment increased the City's share to $200,000. The increase was required because the original estimate was done without making complete, in-depth appraisals. Once the appraisals were completed it became obvious that the City's share was twice the amount originally estimated. Page 2, Item 8 Meeting Date 3/25/86 Unfortunately, neither the original agreement nor its 1973 amendment contained provisions for termination and/or refund of City advances in the event the ramps were not built. Thus, we recommend that Council approve the resolution amending the 1970's agreements with the State to provide for both termination and a basis for refunding of our deposit. It should be noted that this action will not in any way preclude some future cooperative effort between the City and CalTrans under appropriate circumstances.
