REVIEWED BY: City Manager , (4/5ths Vote: Yes No X ) On December 10, 1985, the City Council authorized the hiring of Mr. Bud Gray, Planning Consultant, to function as an overall project manager for the General Plan Update and further authorized the issuance of a request for qualifications for consultant firms interested in performing the scope of work for the update. This agreement covers Mr. Gray' s services for the General Plan as well as the Master Public Facilities Plan. RECOMMENDATION: That Council approve the resolution and authorize the Mayor to execute it on behalf of the City of Chula Vista. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: Mr. Gray had initially begun to work for the City of Chula Vista to update the Eastern Territories planning several years ago. This, however, between 1982 and 1985, his services were utilized as interim Planning Director and consultant to the EastLake Planning Project. In December 1985, Council approved a detailed scope of work and request for qualifications for the General Plan Update. That request was distributed and publicized in January with responses due by the end of this month. Mr. Gray would also coordinate the preparation of the Master Public Facilities Plan together with the Public Works Director. That project statement of qualifications and scope of work should be ready this month and distributed in March. These items will be discussed further at the Council workshop of February 27, 1986, on planning and growth issues and EastLake II. FISCAL IMPACT: Mr. Gray's services can be adequately covered through June 20, 1986, with existing budgeted monies. His services for FY 1986-87 will be addressed at budget time. WPC 2550P CONTRACT FOR PLANNING SERVICES WHEREAS, the City of Chula Vista is presently in need of professional planning assistance in the project management and coordination of various city planning and general planning projects; and WHEREAS, the City of Chula Vista during the past several years has through a consulting contract retained Mr. Bud Gray, an independent planning consultant, to perform various tasks, including Director of Planning; preliminary studies of the General Plan density ranges and the Eastern Territories; as well as project manager for the Eastlake I Plan. WHEREAS, the City of Chula Vista desires to retain Mr. Bud Gray with respect to services as are hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED that the City of Chula Vista and Mr. Bud Gray, an independent contractor and planning consultant do hereby mutually agree as follows: I . PARTIES: The parties to this agreement are the City of Chula Vista, a municipal corporation (hereinafter referred to as "CITY") ; and Mr. Bud Gray, an independent planning consultant (hereinafter referred to as "CONSULTANT") . II. INTENT OF THE PARTIES It is the intent of the CITY and CONSULTANT that CONSULTANT assist the CITY in providing overall project management for the General Plan project, the Public Facilities Plan project and other related planning work. CONSULTANT 'S obligation, as provided further hereinbelow, is to assist the CITY in selecting the consultants for the General Plan and Public Facilities projects, coordinating the consultant' s work with the CITY, monitoring the CONSULTANT'S progress in carrying out the detailed work programs, representing the CITY at various meetings, public presentations and hearings to discuss the projects with various officials, citizens, business organizations and property owners. III . OBLIGATIONS OF THE CONSULTANT CITY, pursuant to this agreement, hereby contracts with Mr. Bud Gray (CONSULTANT) to act on its behalf directly and indirectly and in conjunction with CITY staff in providing the following scope of work: -1- ' .4" A. SCOPE OF WORK: 1 . The development and conduct of the General Plan project shall be as described in the project scope of work prepared by the CITY. The relevant descriptions from that document are attached hereto as Attachment "A" , and thereby incorporated into this document. The development and conduct of the Public Facilities project shall be as prescribed by the CITY. 2 . The CONSULTANT shall regularly consult with the designated CITY staff and the other consultants performing the General Plan and Public Facilities projects for the purpose of monitoring and assessing progress , and to formulate indicated program changes so as to more effectively achieve the project objectives as formulated in Attachment "A" and as prescribed by the CITY. IV. OBLIGATIONS OF THE CITY The CONSULTANT shall coordinate his activities with the Director of Planning and Director of Public Works, who shall, at the expense of the CITY, regularly consult with CONSULTANT for the purpose of guiding the progress of the General Plan and the Public Facilities projects and to formulate project changes so as to more effectively achieve the program objectives as formulated in Attachment "A" and as prescribed by the CITY. A. The CITY shall provide the CONSULTANT at the CITY' S own expense the following: 1 . Work space with telephone, filing cabinet (s) and furniture. 2 . Office supplies and printing and duplicating services . 3 . Typing services. V. COORDINATION OF PROJECT WORK Pursuant to this agreement, CITY shall authorize CONSULTANT to coordinate and expedite , subject to the concurrence of the Director of Planning and the Director of Public Works , all such CITY departments or other governmental agencies as may be necessary to undertake the activities, tasks, reviews, and analysis set forth hereinabove associated with the General Plan and Public Facilities projects, for the purpose of streamlining the CITY'S consideration of said projects and avoiding unnecessary delays in review, duplication of work as between the other consultants and CITY departments, and other inefficient expenditures of staff time. -2- VI . ADMINISTRATION OF CONTRACT The CITY hereby designates the Director of Planning and the Director of Public Works as the CITY'S representatives in the review and administration of the work performed by CONSULTANT pursuant to the terms of the Scope of Work. The parties acknowledge that the Scope of Work may be updated and/or amended from time to time as work progresses. VII. PROJECT SCHEDULE AND COMPLETION DATES The CITY hereby authorizes CONSULTANT to negotiate with the other consultant (s) a detailed work program and schedule for the General Plan and Public Facilities projects. CONSULTANT shall further coordinate the efforts of various CITY departments in negotiating cooperative efforts associated with the General Plan and Public Facilities projects, as well as hearing schedules. VIII. ACCESS TO FACILITIES The CITY shall permit access to its facilities, files and records by CONSULTANT throughout the term of the contract. IX. TERM This agreement shall become effective upon execution as authorized by the Mayor of the CITY, or his designee, and shall terminate, if not terminated pursuant to other provisions contained herein, or otherwise extended by all parties , on January 1 , 1987 . X. COMPENSATION The compensation to be paid by CITY to CONSULTANT shall be $60 .00 per hour for each hour worked. CONSULTANT shall submit monthly invoices to the Director of Planning of the CITY. Payment shall be made to CONSULTANT within thirty (30) days . The CITY agrees to pay the total sum billed by the CONSULTANT each month for the duration of this agreement. CONSULTANT'S hourly rate shall remain fixed during the term of this contract, provided, however, any extension of said contract shall include a re-negotiation of the CONSULTANT' S hourly rate. XI . INTEREST OF CONSULTANT CONSULTANT presently has no business relationship with any persons or firms doing business within the Chula Vista planning area that would constitute a conflict of interest or give the appearance of such conflict. -3- XII. TERMINATION OF AGREEMENT FOR CAUSE If, through any cause, CONSULTANT shall fail to fulfill in a timely and proper manner his obligations under this agreement, or if CONSULTANT shall violate any of the covenants, agreements, or stipulations of this agreement, CITY shall have the right to terminate this agreement by giving written notice to CONSULTANT of such termination and specifying the effective date thereof at least five (5) days before the effective date of such termination. In that event, all finished or unfinished documents, data, studies, surveys, drawings, maps, reports, and other materials prepared by CONSULTANT shall, at the option of the CITY, become the property of the CITY, and CONSULTANT shall be entitled to receive just and equitable compensation for any work satisfactorily completed on such documents and other materials up to the effective date of notice of termination, not to exceed the amounts payable under Paragraph X hereinabove. XIII . TERMINATION FOR CONVENIENCE OF CITY CITY may terminate this agreement at any time and for any reason by giving specific written notice to CONSULTANT of such termination and specifying the effective date thereof, at least thirty (30) days before the effective date of such termination. In that event, all finished and unfinished documents and other materials described in Paragraph XII hereinabove shall , at the option of CITY, become CITY' S sole and exclusive property. If the agreement is terminated by CITY as provided in this paragraph, CONSULTANT shall be entitled to receive just and equitable compensation for any satisfactory work completed on such documents and other materials to the effective date of such termination. CONSULTANT hereby expressly waives any and all claims for damages or compensation arising under this agreement except as set forth in Paragraph X hereinabove in the event of such termination. XIV. ASSIGNABILITY CONSULTANT shall not assign any interest in this agreement, and shall not transfer any interest in the same (whether by assignment or novation) , without prior written consent of CITY. XV. OWNERSHIP, PUBLICATION, REPRODUCTION AND USE OF MATERIAL All reports, studies, information, data, statistics, forms, designs, plans, procedures, systems, and any other materials or properties produced under this agreement shall be the sole and exclusive property of CITY. No such materials or properties produced in whole or in part under this agreement shall be subject to private use , copy rights , or patent rights by CONSULTANT in the United States or in any other country without the express written consent of CITY. CITY shall have -4- unrestricted authority to publish, disclose (as may be limited by the provisions of the Public Records Act) , distribute, and otherwise use, copyright or patent, in whole or in part, any such reports, studies, data, statistics , forms or other materials or properties produced under this agreement. XVI. INDEPENDENT CONTRACTOR CITY is interested only in the results obtained and CONSULTANT shall perform as an independent contractor with sole control of the manner and means of performing the services required under this agreement. CITY maintains the right only to reject or accept CONSULTANT' S final work product. CONSULTANT and any of CONSULTANT'S agents , employees, or representatives are , for all purposes under this agreement, an independent contractor, and shall not be deemed to be an employee of CITY, and none of them shall be entitled to any benefits to which CITY employees are entitled, including but not limited to, overtime , retirement benefits, worker' s compensation benefits, injury leave, or other leave benefits. XVII. CHANGES CITY may from time to time require changes in the scope of the services by CONSULTANT to be performed under this agreement. Such changes, including any increase in the amount of CONSULTANT ' S compensation, which are mutually agreed upon by CITY and CONSULTANT shall be effective as amendments to this agreement only when in writing. OBJECTIVE The City of Chula Vista is in need of professional planning consultant services. The objective of this program is to carry out a series of interrelated studies to enable the City to choose a plan to guide future growth and development. Particular attention shall be devoted to identifying strategic planning opportunities and practical methods of implementing selected plans and programs. , II. BACKGROUND The City of Chula Vista presently occupies 25 square miles within a planning area of nearly 70 square miles. The City' s current population exceeds 90,000 and will expand by 3.5 square miles and an additional 23,000 people with the recent annexation of the Montgomery community. The City is actively involved in four redevelopment project areas, including the Town Centre, Bayfront, Otay Valley Industrial Park and the Chula Vista Shopping Center. In addition, several large scale new communities are in various stages of planning and/or construction. Two of these projects - El Rancho del Rey and EastLake I, have been recently reviewed by the City Council and are proceeding toward construction. These two projects alone will add over 20,000 residents to the City over the next 20 years. EastLake II, a substantial extension of EastLake I, is now being pre-planned. The other two remaining large ownerships within the City's eastern planning area consist of a 2600 acre parcel known as Bonita Ranch and a 10,000 acre ownership held by United Enterprises. Both of these areas are likely candidates for annexation to the City sometime in the future. With the amount of change currently going on within the City and the potential for new development seeking annexation in the future, the City is in need of a fresh look at its strengths and weaknesses and opportunities for maximizing its potential . The new General Plan will serve as a tool in assisting the City to define its options, focus its direction and carry through with effective implementing strategies. IV. SCOPE OF SERVICE Under the general supervision of the Planning Director, the consultant shall prepare a draft comprehensive General Plan to provide guidance for the conservation and development of the Chula Vista Planning Area. The following outline of comprises the scope of work. A. Outline of the Content and Format of the New Chula Vista General Plan I. Phase 1 : Preparation of Constituent Plans (Products) a. Constituent Products To further define the scope of work requirements, the following discussion of the content of the constituent products is provided: a. Product/Land Use and Open Space Plan for the Eastern Territories This Product calls for the preparation of a comprehensive plan for the 25 square miles of land constituent to the Eastern Territories of the Chula Vista Planning Area. This task would entail the development of goals, objectives, policies, and proposals for growth, development, and conservation. The said - 2 - proposals would include land use and open space allocations; gross residential density parameters; circulatory-corridor designations; urban-form projections; growth and development phasing and sequentializing strategies; and, public- finance guidelines and strategies. This Product requires the active participation of the property owners in all phases of the planning process. b. Product/Master Environmental Impact Report An Environmental Opportunities and Constraints inventory would be a first sub-product in developing a data base. This next product calls for the preparation of a master environmental impact report. Included herein would be a summary description of the preliminary general plan and alternatives. Also, a discussion of the "no project alternative," as well as an evaluation of the environmental impacts of each option. The analysis, including the identification of mitigation measures, would include land use, traffic circulation, biology, archaeology, public services, drainage, visual quality, noise, growth indication, geology/soils, air quality and fiscal impact analysis. c. Product/Montgomery Specific Plan The Specific Plan proposed for the Montgomery Community would be governed by Chapter 19.07 of the Chula Vista Municipal Code, and would be, in substance and format, a detailed, large-scale version of a General Plan. It would be identifiable with the "community plans" of San Diego County and the City of San Diego. It is proposed that the Montgomery Specific Plan embody goals, objectives, and statements of policy on matters which pertain to growth and development and proposals for the physical revitalization and replatting of the urban fabric. Where special land-use, bulk, height, or parking standards are indicated, the Montgomery Specific Plan should include them. The Montgomery Community, which developed as unincorporated territory, has a population in excess of 23,000. It requires imaginative and intuitive public-facility, public-finance, and economic-development planning, as well as organic physical planning. These factors stress the importance of the Montgomery Specific Plan. Montgomery has several well-defined subcommunities; namely, Castle Park, Otay, Harborside, Woodlawn Park, Broderick Acres, and Fairfield. An effective specific plan for Montgomery must address these subcommunities and their individual needs, as well as the needs of the community, the City of Chula Vista, and the South Bay Subregion. - 3 The Draft Montgomery Specific Plan will be prepared under the aegis of a senior contract planner and planning department staff along with the Montgomery Planning Committee. The consultant will need to review that effort on an on-going basis and synthesize it into the overall City Master General Plan. d. Product/Sweetwater Specific Plan This product, as in the case of the Montgomery area calls for the preparation of a specific plan. However, while Montgomery is urban in nature, much of Sweetwater is rural and residential-estate in character, and therefore has different city-planning problems. In Sweetwater, which is composed of the Bonita and Sunnyside Communities, the orderly extension of the settlement pattern is of primary importance. The Specific Plan should emphasize growth control , environmental quality, amenity, and order. It should also address public facilities, traffic and transportation, and the protection of the Bonita-Sunnyside quality-of-life from the impacts of external growth and development. The Sweetwater Community Planning Group and the Sweetwater Valley Civic Association are actively engaged in the planning of the area in question, and their participation in the formulation of the Specific Plan is essential . Other groups and individuals in the area should also be encouraged to provide input into the subject planning effort. e. Product/Central Chula Vista Organic Plan The Central Chula Vista Community, which is generally bounded by the Bayfront, I-805, and "C" and "L" Streets, is the birthplace of the municipality, and the heart of the Chula Vista Planning Area. While its urban fabric remains orderly and viable, its several neighborhoods should be restudied, and a well- organized program, based upon continuing organic planning should be formulated in order to prevent its decline. This product calls for the preparation of neighborhood and commercial-area conservation and rehabilitation programs and strategies. It also should provide guidelines for redevelopment, where this activity is necessary. Furthermore, there are indications that some parts of the Central Community should be redesignated to different land-use categories, or guided by different residential density policies. These matters should also be addressed by the consultant. - 4 - The subject product should place special emphases upon the public facilities required by the Central Chula Vista Community. Where extensive expenditures for these facilities are suggested, capital improvement programs and public- finance strategies should be proposed. The product in question should also place considerable emphasis on urban beautification. The planning consultant will require much advisory input in order to prepare this product. This input could be provided by a special committee of local residents and business people appointed by the City Council . f. Product/Community Design Element The City of Chula Vista's planning program stresses urban design, and this city has adopted a citywide design manual , as well as special design manuals for its several redevelopment projects. The proposed Community Design Element should contain goals, objectives, statements of policy, principals, standards, and proposals which would extend the scope of urbane design and townscape planning to all development and conservation activities within the Chula Vista Planning Area, including the grading of land, the landscaping of rights-of-way and watercourses, the subdivision of residential areas, and the revitalization of commercial and industrial districts. While the proposed element should be basically general , it should also identify problem areas within the Planning Area, and suggest remedial design solutions. The element should be copiously illustrated. The Community Design Element should incorporate or restate the principles and proposals of the City' s several manuals, and thereby provide a sense of unity to its urban design processes. g. Product/Amendment and Integration of Existing General Plan Elements The Chula Vista General Plan presently consists of twelve elements. Most of these plans require updating refinement, or amendment. Some of the elements should be integrated with other elements in order to reduce the massiveness of the General Plan. This reduction should increase the Plan' s clarity and readability, and promote its general use. The proposed amendments and integration will provide the City with the opportunity to develop a new format for the text and graphics of the General Plan. The new format, if predicated upon a serious effort on the part of the consultant to use succinct language and supportive illustrations could produce a General Plan document which would experience broad public acceptance and support. - 5 - V. TASKS TO BE ACCOMPLISHED Each work product will require a certain sequence of tasks to be undertaken. Generally, these tasks would include the following: A. TASK 1 - ORGANIZE COMMUNITY PARTICIPATION 1 . A community participation component will need to be identified to assist with each product. This could include a general plan committee of residents and business representatives from the planning area, existing Planning Committee members, major property owners and the Planning Commission and Council . B. TASK 2 - INVENTORY - EXISTING CONSTRAINTS AND OPPORTUNITIES 1. The consultant shall perform a field reconnaissance to observe the physical characteristics of the planning area. 2. The consultant shall research and review previous plans, studies, city council policies and ordinances pertaining to the planning and development of the city. 3. The consultant shall research and evaluate opportunities and constraints associated with the City's historical development pattern and characteristics; potential for economic growth, real estate development, demographic trends, household characteristics, neighborhood characteristics, and prepare a summary of findings. 4. The consultant shall prepare a number of maps and reports to display the results of where Chula Vista stands today in terms of its historical development, present conditions, an evaluation of constraints and opportunities which will affect future events. C. TASK 3 - CONDUCT AN OPINION SURVEY 1 . Survey residents and businesses as to their perception of the City and their opinion of future directions. 2. Survey City Council , Planning Commission and selected city committees. D. TASK 4 - DATA SYNTHESIS AND ISSUES IDENTIFICATION 1 . The consultant shall prepare a summary report on the inventory/survey phase, including conclusions and/or suggestions for future study. 2. The consultant shall prepare a list of issues identified from research interviews and surveys regarding the principal areas of emphasis for planning analysis and General Plan work program. - 6 - E. TASK 5 - GOALS AND OBJECTIVES 1. Prepare summary of existing goals and objectives from review of adopted plans. 2. Prepare goals and objectives for discussions with General Plan Committee and interested civic groups and organizations. 3. Finalize preliminary goals and objectives for City Council approval. F. TASK 6 - GENERAL POLICIES 1. Prepare outline of alternative; policies based on goals and objectives, issues identification and opinion survey. 2. Review with General Plan Committee and finalize. G. TASK 7 - EVALUATION 1. Prepare evaluation of preferred goals, objectives, general policies vis-a-vis identified issues from Phase I, Task 4. H. TASK 8 - PLAN PREPARATION INCLUDING ALTERNATIVES I.
