HomeMy WebLinkAboutAgenda Statement 1986/02/25 Item 10 COUNCIL AGENDA STATEMENT Item 10 Meeting Date 2/25/86 ITEM TITLE: Resolution 1;3 51 Accepting public improvements, a portion of East "H" Street, Bonita Long Canyon SUBMITTED BY: Director of Public Works/City Engineer REVIEWED BY: City Manager (4/5ths Vote: Yes No X ) McMillan Development Company has requested that the City accept for maintenance and public liability that portion of East "H" Street, east of Auburn Avenue to Corral Canyon Road in Bonita Long Canyon Subdivision. RECOMMENDATION: That Council adopt resolution accepting the public improvements for maintenance and public liability. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: On October 15, 1985, by Resolution 12204 Council approved an agreement amending the Subdivision Improvement Agreement by relieving McMillan Development Company from liability resulting from the use of portions of Otay Lakes Road and East "H" Street by the public. The agreement also allows acceptance of the improved street prior to completion of the other subdivision improvements required for Bonita Long Canyon Subdivision. McMillan Development Company has posted Guarantee Bond No. 13-52-00 from the Insurance Company of the West in the amount of $79,000.00 to guarantee the improvements as to material and workmanship for one year after the date of acceptance by the City Council . The public improvements are shown on plans numbered 85-150, 85-151 , 85-284 and 85-285. All work has been completed in accordance with the approved plans and specifications and to the satisfaction of the City Engineer. Because of heavy rains during October, November and December of 1985, Rutgers Avenue has not been improved with two lanes as previously anticipated. In addition, Otay Water District has also required the installation of a water line prior to paving. It is now our expectations that the two lanes on Rutgers Avenue between Gotham Street and East "H" Street will be completed within 30 days.
