(4/5ths Vote: Yes No X ) As a condition of approval of Tentative Parcel Map 86-4, the owner of the property at the south end of Las Flores on the east side was required to apply to the City for vacation of the portion of public alley running along the west side of his property. The owner has made the application and paid the prescribed fee. In accordance with Part 3, Chapter 3, Section 8320 of the California Streets and Highways Code, the Council must adopt a resolution of intention to vacate the subject alley and set a date for the required public hearing for initiation of the vacation process. RECOMMENDATION: That the Council adopt the subject resolution of intention and set the public hearing for March 11 , 1986. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: L & V Investments, owner of the property at the south end of Las Flores Drive ( see Exhibit "A") submitted a Tentative Parcel Map to the City in October of 1985. One of the conditions of approval of the map was the requirement of the owner to request that the City vacate the portion of the public alley on the west side of the property. Application was made on January 17, 1986. In order to initiate the vacation process, the City Council must adopt a resolution which includes: 1 . A declaration of intention to vacate. 2. A statement that the vacation is proceeding under Part 3, Chapter 3, of the California Streets and Highways Code. 3. A description of the general location and extent of the right of way to be vacated. 4. Setting a public hearing in the Council Chambers on March 11 , 1986, at 7:00 p.m. at which all interested parties may be heard. Page 2, Item 10 Meeting Date 2/18/86 All utility companies have been given the opportunity to comment upon the proposed alley vacation. They will be responding by letter to indicate their interests. The City will reserve easements for its storm drain and sewer facilities which are located within the affected right-of-way. A transparency is available for Council viewing. FISCAL IMPACT: None.
