The Final Maps for CVT 84-9, EastLake I, Units 15 and 16 have been reviewed by
the Engineering Department and found to be in conformity with the Tentative
Map approved by the City Council on February 19, 1985, by Resolution No. 11935.
The improvement plans for Units 15 and 16 have not yet been completed.
However, a supplemental agreement providing for the timely completion of these
plans has been prepared for Council consideration. This procedure of
approving final map prior to approval of improvement plans was used for
approval of the Final Maps for CVT 84-9, EastLake I Units 1 , 2, 3, 4, 5, 6, 7,
and 10. Bonds for 100% of the total cost of public improvements plus a 50%
contingency have been submitted by the developer to guarantee this work. All
other necessary documents have also been submitted and appropriate fees have
been paid. Except for model homes, no building permits will be released until
improvement plans are approved.
The construction of improvements will not begin until the appropriate plans
are approved.
RECOMMENDATION: That Council adopt resolutions "a" and "b" as listed in the
item title of this report.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
The improvement bonds for 100% of total cost of public improvements plus a 50%
contingency have been submitted, but the improvement plans have not been
approved by the City Engineer. Approval of the improvement plans (for
streets, sewers and lighting) will take another 4 to 5 weeks. The plans have
been checked at least once by City staff.

The Final Maps for Units 15 and 16 (which are the legal documents creating the
lots and dedicating all of the streets and easements within the subdivisions
are satisfactory to staff and are recommended for Council approval . All the
conditions of approval placed upon the Tentative Map have been met except for
final approval of the improvement plans as discussed above. Because of the
conditions included in the supplemental agreement, I believe that approving
the Final Maps prior to final approval of the improvement plans is reasonable.
All of the implementation elements of the Public Facilities and Financing Plan
have not been completed. The Supplemental Agreement provides that EastLake
will pay an interim impact fee for their fair share of: 1 ) off-site roads,
including four-lane facilities for State Highway 125, 2) fire station, and 3)
community park prior to approval of building permits. EastLake will enter
into an agreement to dedicate land for the fire station, and 1 .5 acres for the
community park. Another 10 acres will be dedicated with EastLake II. They
will also agree to include as a map condition for the first phase of the
Village Center to dedicate land and construct the Transit Center as well as
dedicate land for a library site and provide for an interim store-front
facility.
It is estimated that the development impact fee for the facilities discussed
above will approximate $2,000 for a single-family home for which a building
permit is obtained shortly. It will be adjusted in accordance with changing
costs of construction of facilities. Upon adoption of an ordinance by the
City Council for the establishment of a development impact fee as a part of
the Facilities Financing Plan, the actual amount will be paid by EastLake
Development Company prior to issuance of individual building permits.
A plat is available for Council viewing.
