Resolution /9 Approving Final Map, Subdivision Improvement Agreement and Supplemental Improvement Agreement and authorizing the Mayor to execute said agreement for EastLake I, Unit 10 of CVT 84-9 SUBMITTED BY: Director of Public Works/City Engineer )0' REVIEWED BY: City Manage (4/5ths Vote: Yes No X ) The Final Maps for EastLake I, Units 3 and 10 have been reviewed by the Engineering Department and found to be in conformity with the Tentative Map approved by the City Council on February 19, 1985, by Resolution No. 11935. The approval and recordation of the Final Map for Unit 3 will only create a legal parcel of land for the purpose of transferring title to said parcel . No building permits will be issued as a result of this approval . However, Lane/Kuhn Pacific Development Company, a California General Partnership, as optionee under an unrecorded option development agreement will be submitting a final map which will consist of 93 single family units in the near future. The latter map will be the document that will enable the developer to obtain building permits. The construction of improvements for Unit 3 will not begin until the map consisting of 93 single family lots is recorded and the appropriate improvement plans are approved. The improvement plans for Unit 10, however, are approved and all bonds are received. RECOMMENDATION: That Council adopt resolutions "a" and "b" as listed in the item title of this report. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: EastLake Development Company requested the approval and recordation of the Map to create a legal lot over said unit and to consequently enable them to sell the land contained within that unit. Approving the map for Unit 3 will not include any dedication or grants of easements. Dated ____. Page 2, Item 6 Meeting Date 1/28/86 The improvement plans for Unit 10 are approved and all bonds are submitted. Said bonds were included in a Subdivision Improvement Agreement accepted by Council on December 17, 1985, by Resolution No. 12306 for Unit 6 of EastLake I. An additional survey monumentation bond will be submitted prior to recordation of the map for Unit 10. Approval of this map will include accepting Rue Avallon as a public street, the necessary sewer and drainage easements over those utility lines serving the unit and the street tree planting and maintenance easements along said street. All of the implementation elements of the Public Facilities and Financing plan have not been completed. The Supplemental Agreement provides that EastLake will pay an interim impact fee for their fair share of: 1 ) off-site roads, including 4-lane facilities for SR 125, 2) fire station, and 3) community park prior to approval of building permits. EastLake will enter into an agreement to dedicate land for the fire station, and 1 .5 acres for the community park. Another 10 acres will be dedicated with EastLake II. They will also agree to include as a map condition for the first phase of the Village Center to dedicate land and construct the Transit Center as well as dedicate lands for a library site and provide for an interim store front facility. It is estimated that the development impact fee for the facilities discussed above will approximate $2,000 for a single family home for which a building permit is obtained shortly. It will be adjusted in accordance with changing costs of construction of facilities. Upon adoption of an ordinance by the City Council for the establishment of a development impact fee as a part of the Facilities Financing Plan, the actual amount will be paid by EastLake Development Co. prior to issuance of individual building permits.
