ITEM TITLE: Report - Comparison of Rules and Regulations for Lauderbach
Community Center and City Rules and Regulations governing City
recreation facilities.
Resolution 4;2,5413 Amending Resolution #11309 regarding

Parks and Recreation Facilities to include Lauderbach

On December 31 , 1985, the City assumed the responsibility of administering and
operating the Lauderbach Community Center. The existing Rules and Regulations
governing the Use Permit for Lauderbach are in conflict with City policy.
Therefore, an amendment to the City Rules and Regulations governing the Use
Permits for Parks and Recreation facilities is necessary to include the
Lauderbach Community Center.
RECOMMENDATION: That Council accept report and amend Resolution #11309 to
include Lauderbach Community Center under the Rules and Regulations governing
the Use Permits for Parks and Recreation Facilities

DISCUSSION:
The City assumed responsibility for the operation and administration of the
Lauderbach Community Center on December 31 , 1985. The former operator, MAAC
Project, made several commitments to rent the Community Center. Fifteen
rental agreements are scheduled through June 1986.
The Rules and Regulations that existed under the former operator are in
conflict with City's Rules and Regulations. The following is a comparison of
the major conflicts governing the Lauderbach Community Center and City' s
facilities:

Staff is primarily concerned with the allowance of alcoholic consumption,
rental of facility until 2:00 a.m. At a "Quincenaera" held on Saturday,
January 11 , 1986, the party was closed down at 10:30 p.m. because the number
attending exceeded the capacity of the building by 200 people. The former
director stated that serious problems have been common due to the excessive
drinking allowed.
It is the City Attorney' s opinion that the City is obligated to honor the
existing agreements. However, the City Attorney stated that stringent
conditions to the usage may be imposed to ensure safety and welfare of
participants and property.
The department will institute the following additional measures with the
previously approved rentals:
1 . Limit the number of guests to a maximum of 250 for a dinner/dance party,
and 500 for a dance only. This will comply with Fire Code Regulations.
2. Strictly enforce "no drinking of alcoholic beverages" for minors.

3. Maintain sound of bands to an acceptable level to ensure the peace and
tranquility of adjoining neighbors.
Any violation of the above conditions will be grounds to cancel and close down
the parties.
For all new rental requests, the City' s Rules and Regulations will be in
effect. The major changes will include:
1 . Alcoholic beverage consumption will be allowed on special occasion by
approval of Director of Parks and Recreation. Alcohol will not be
permitted at function with primarily minors in attendance. Under no
circumstances will sale of alcoholic beverage be permitted.
2. Rental fee schedule for Lauderbach Community Center will be similar to
other City facilities. The City' s policy encourage usage by community
groups and residents.
3. Rental hours will be limited to 12:00 midnight on Friday and Saturday and
11 :00 p.m. on other nights.
4. Staff will be assigned to all rentals.
5. Cleaning and Damage Deposit will be $200 if no alcohol is being served,
and $300 with alcohol at the function. All but $75 will be refundable if
no damages occur. The $75 will be used to contract private custodial
service.
In order to include Lauderbach Community Center under the City' s existing
policy, it will be necessary to amend Resolution #11309 to include Lauderbach
Community Center (see attached Exhibit "A").
FISCAL IMPACT: Imposing conditions for the consumption of alcoholic
beverages and limiting the hours of rentals may reduce the demand for the
facility rentals. However, complete usage of facility will generate revenue
from other programs to offset this loss.
