HomeMy WebLinkAboutReso 1990-15968 RESOLUTION NO. 15968 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THE PROPOSED "TWO ROADS TO BE WIDENED ANNEXATION" The City of Chula Vista does hereby resolve as follows: WHEREAS, an original application was filed by Resolution No. 15722 of the City of Chul a Vista in July 1990, for a partial boundary determination within a Special Study Area of the Sphere of Influence and annexation for approximately 71.22 acres from the unincorporated area of the County to the City of Chula Vista; and, WHEREAS, the reason for the annexation is to facilitate road widening and improvements to Telegraph Canyon Road and Orange Avenue and to keep those roads, once widened, under one jurisdiction; and, WHEREAS, the final application and resolution were certified as sufficient by LAFCO on August 29, 1990, subsequent to City adoption of the Negative Declaration and Addendum by Resolution No. 15723, and establishment of prezoning for the area by Ordinance No. 2394; and, WHEREAS, the subject territory is variably shaped area consisting of two separate parts the first lying to the south of Telegraph Canyon Road between Paseo Ladera and Rutgers Avenue, and the second being the southerly one-half of Orange Avenue for a third of a mile east of Hunte Parkway (as described in attached Exhibits A, B and C); and, WHEREAS, on October 1, 1990, the Local Agency Formation Commission adopted a written statement of Determinations making changes to the Sphere of Influence boundary and a resolution approving the proposed annexation {Reference Nos. SA-90-5, CA-90-5); and, WHEREAS, in accordance with the provisions of the Cortese/Knox Local Government Reorganization Act of 1985, the LAFCO has designated the City of Chula Vista as conducting authority and referred the matter for determination; and, WHEREAS, the property to be annexed shall not be taxed for any existing bonded indebtness; and, WHEREAS, the regular County addressmerit role shall be utilized; and, WHEREAS, pursuant to Sections 57002, 57025, and 57026 of the Government Code, the matter was set for public hearing at the Council meeting of December 4, 1990, at 4:00 p.m. in the Council Chambers. Resolution No. 15968 Page 2 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista pursuant to Government Code Section 57082 approves the annexation in accordance with the following terms and conditions: 1. The boundaries of the territory described in Exhibit C, attached hereto, have been modified in accordance with LAFCO. 2. The City Clerk of the City of Chula Vista is hereby authorized and directed to transmit a copy of this resolution in accordance with Section 57200 of the Government Code.
