The Final Maps for EastLake I Units 1 , 2, 4, 5, 6 and 7 have been reviewed by
the Engineering Department and found to be in conformity with the Tentative
Map approved by the City Council on February 19, 1985, by Resolution No. 11935.
The improvement plans for said units have not yet been completed. However, a
supplemental agreement providing for the timely completion of these plans and
all non-tentative map public improvements has been prepared for Council
consideration. This procedure of approving Final Map prior to approval of
improvement plans was used for approval of the Final Map for Hidden Vista

Village (Terra Nova). It is also employed in the City of Irvine and other
Southern California agencies without causing problems. Bonds (100% of the
total cost of public improvements and a 50% contingency) guaranteeing this
work will be submitted by the developer prior to the recordation of the maps.
The agreement provides that EastLake will pay its fair share of 1 ) off-site
road facilities, 2) fire station, and 3) community park. Letters have been or
will be received prior to recordation of the maps from the school districts
stating that an agreement has been reached between the developer and the
school districts for payment of fees.
Additional documents may also not be received prior to Council action and it
is proposed that staff be instructed to hold the maps pending such receipt.
The construction of improvements will not begin until the appropriate
improvement plans are approved.
RECOMMENDATION: That Council adopt resolutions "a" through "f" as listed in
the item title of this report.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
The improvement bonds (100% of total cost of public improvements and a 50%
contingency) will be submitted prior to recordation of Final Maps, but the
improvement plans will not have been finally approved by the City Engineer.
Final approval for the improvement plans (for streets, sewers and lighting)
will take another 30 to 45 days. All of the plans have been checked at least
once by City staff.
The Final Maps for Units 1 , 2, 4, 5, 6 and 7 (which are the legal documents
creating the lots and dedicating all of the streets and easements within the
subdivisions) are satisfactory to staff and are recommended for Council
approval . All the conditions of approval placed upon the Tentative Map have
been met except for final approval of the improvement plans as discussed
above. Because of the conditions included in the supplemental agreement, I
believe that approving the Final Maps prior to final approval of the
improvement plans is reasonable.
All of the implementation elements of the Public Facilities and Financing plan
have not been completed. The Supplemental Agreement provides that EastLake
will pay an interim impact fee for their fair share of: 1 ) off-site roads,
including 4-lane facilities for 125, 2) fire station, and 3) community park
prior to approval of building permits. EastLake will enter into an agreement
to dedicate land for the fire station, and 1 .5 acres for the community park.
Another 10 acres will be dedicated with EastLake II. They will also agree to
include as a map condition for the first phase of the Village Center to
dedicate land and construct the Transit Center as well as dedicate land for a
library site and provide for an interim store front facility.

It is estimated that the impact fee for the facilities discussed above will
approximate $2,000 for a single family home. Upon adoption of an ordinance by
the City Council for the impact fee as a part of the Facilities Financing
Plan, the actual amount will be paid by EastLake.
Additional easements for street purposes along the south and north sides of
East "H" Street from the easterly line of Bonita Long Canyon Subdivision to
the southerly line of this subdivision, and along the east and west side of
Rutgers Avenue from East "H" Street south to the existing Rutgers Avenue are
required and are presented to Council for acceptance in order to provide full
public right-of-way for both streets with the Unit 1 resolution.
McMillin Development, Inc. and United Enterprises are also granting to the
City drainage and slope rights easements as a result of an agreement between
them and EastLake Development Company. Said easements are also presented to
Council for acceptance with Unit 1 approval .
The documents for each of the parcels being accepted have been submitted to
the City and are properly executed. The document for Parcel 1 is to be
provided to the City after execution by United Enterprises under the terms of
an executed agreement between EastLake and United Enterprises.
These documents are:
Parcel 2: Easement for drainage purposes granted to the City by McMillin
Development Company on the southeast corner of Bonita Long
Canyon Unit 1 .
Parcel 3: Easement for drainage purposes granted to the City by McMillin
Development, Inc. on the south side east corner of Bonita Long
Canyon Unit 1 .
Parcel 4: Easement for drainage purposes granted to the City by EastLake
Development Company on the southwest corner of EastLake I
Hills/Shores.
Parcel 5: Easement for drainage purposes granted to the City by EastLake
Development Company along the south side of East "H" Street
between Rutgers Avenue and the 80-foot San Diego County Water
Authority Easement.
Parcel 6: Easement for drainage purposes granted to the City by EastLake
Development Company from the south side of East "H" Street to
Lake Shore Drive through EastLake I Unit 3.

DISCUSSION:
The improvement bonds (100% of total cost of public improvements and a 50%
contingency) will be submitted prior to recordation of Final Maps, but the
improvement plans will not have been finally approved by the City Engineer.
Final approval for the improvement plans (for streets, sewers and lighting)
will take another 30 to 45 days. All of the plans have been checked at least
once by City staff.
The Final Maps for Units 1 , 2, 4, 5, 6 and 7 (which are the legal documents
creating the lots and dedicating all of the streets and easements within the
subdivisions) are satisfactory to staff and are recommended for Council
approval . All the conditions of approval placed upon the Tentative Map have
been met except for final approval of the improvement plans as discussed
above. Because of the conditions included in the supplemental agreement, I
believe that approving the Final Maps prior to final approval of the
improvement plans is reasonable.
All of the implementation elements of the Public Facilities and Financing plan
have not been completed. The Supplemental Agreement provides that EastLake
will pay an interim impact fee for their fair share of: 1 ) off-site roads,
including 4-lane facilities for 125, 2) fire station, and 3) community park
prior to approval of building permits. EastLake will enter into an agreement
to dedicate land for the fire station, and 1 .5 acres for the community park.
Another 10 acres will be dedicated with EastLake II. They will also agree to
include as a map condition for the first phase of the Village Center to
dedicate land and construct the Transit Center as well as dedicate land for a
library site and provide for an interim store front facility.

It is estimated that the impact fee for the facilities discussed above will
approximate $2,000 for a single family home. Upon adoption of an ordinance by
the City Council for the impact fee as a part of the Facilities Financing
Plan, the actual amount will be paid by EastLake.
Additional easements for street purposes along the south and north sides of
East "H" Street from the easterly line of Bonita Long Canyon Subdivision to
the southerly line of this subdivision, and along the east and west side of
Rutgers Avenue from East "H" Street south to the existing Rutgers Avenue are
required and are presented to Council for acceptance in order to provide full
public right-of-way for both streets with the Unit 1 resolution.
McMillin Development, Inc. and United Enterprises are also granting to the
City drainage and slope rights easements as a result of an agreement between
them and EastLake Development Company. Said easements are also presented to
Council for acceptance with Unit 1 approval .
The documents for each of the parcels being accepted have been submitted to
the City and are properly executed. The document for Parcel 1 is to be
provided to the City after execution by United Enterprises under the terms of
an executed agreement between EastLake and United Enterprises.

The Final Maps for EastLake I Units 1 , 2, 4, 5, 6 and 7 have been reviewed by
the Engineering Department and found to be in conformity with the Tentative
Map approved by the City Council on February 19, 1985, by Resolution No. 11935.
The improvement plans for said units have not yet been completed. However, a
supplemental agreement providing for the timely completion of these plans and
all non-tentative map public improvements has been prepared for Council
consideration. This procedure of approving Final Map prior to approval of
improvement plans was used for approval of the Final Map for Hidden Vista
Chub

Village (Terra Nova). It is also employed in the City of Irvine and other
Southern California agencies without causing problems. Bonds (100% of the
total cost of public improvements and a 50% contingency) guaranteeing this
work will be submitted by the developer prior to the recordation of the maps.
