ITEM TITLE: Emergency Ordinance '� - C Amending Section 10.62.010(B) of
Chapter 10.62 of the Chula Vista Municipal Code Relating to
the Parking Fees for the Purpose of Regulating the Use of
Streets

Chapter 1040, Statutes 1985, will go into effect on January 1, 1986. Said law
provides for a $1.50 surcharge on each parking violation for the Courthouse
Temporary Construction Fund. This ordinance will implement the provisions of
Chapter 1040 and provide a $.50 per citation administrative fee for the City.
The total increase shall amount to $2 for all violations.
RECOMMENDATION: Adopt the emergency ordinance.

DISCUSSION:
The City Attorney's office, in conjunction with the Finance Department, has
prepared the proposed emergency ordinance to implement Chapter 1040 of the
1985 Statutes. The Board of Supervisors has adopted a resolution for the
implementation of Chapter 1040's provisions. Said chapter provides the Board
of Supervisors with the authority to impose a surcharge of $1.50 on each
parking violation within the County. The funds from said surcharge shall be
deposited into the Courthouse Temporary Construction Fund. These monies may
be used only for the acquisition, rehabilitation, construction and financing
of courtrooms, courtroom buildings or buildings containing facilities
necessary to the operation of the courts.
As a result of this statute, the City will incur expenses for the printing of
new tickets and administrative costs. In December of 1981, the City was
placed in a similar situation and determined that $.50 per citation would be
adequate to cover the City's costs.
This ordinance is being presented as an emergency ordinance due to the need to
preserve the public peace and safety as required by Chula Vista Charter
Section 311. In the event this ordinance is not in effect by January 1, 1986,
the ability of the Police Department to cite parking violators will be
impaired because of the ambiguity as to the appropriate bail.
