ITEM TITLE: Resolution /P 7 Approving agreement for a Tennis
Professional

The Chula Vista Tennis Center has been operating with a temporary Tennis
Professional since October 1983. Requests for Proposal for the operation of
the Tennis Center were solicited in September 1985.
RECOMMENDATION: That Council adopt resolution approving the Agreement for
Tennis Professional.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
The City opened the Chula Vista Tennis Center complex at Southwestern College
in 1972, under a Joint Powers Use Agreement with the Sweetwater Community
College District. The Center was to be operated under contract with a Tennis
Professional whose main duties would include:
1 . Operation and supervision of a Pro Shop
2. Development of a comprehensive tennis program, including instructions for
adults and youth
3. Coordination of City-sponsored tennis events, tournaments, clinics, etc.
4. Daily maintenance of the four City courts
Since the opening of the Chula Vista Tennis Center in 1972, the City has
entered into contracts with several Tennis Professionals. Gary Quandt's
tenure from January of 1983 was the last permanent appointment. Each and all
of the previous Tennis Professionals requested termination of their agreement
with the City due to financial problems.
In June 1985, the temporary Tennis Professional , Caesar Regundin, requested
permission to establish a Pro Shop. Mr. Regundin secured a tentative
agreement with a tennis supplier to stock merchandise in the Center. Requests
for proposals were solicited in August, 1985, based on the renewed interest
for a pro-shop operation. Mr. Frank Chaboudy, and Caesar Regundin submitted
proposals for the operation of the Tennis Center. •
withdrew his proposal and endorsed Mr. Chaboudy.

Frank Chaboudy is a well known local tennis professional . His experience
includes teaching at Ed Collin's Tennis College at Rancho Bernardo and the
Valley Tennis Club in Mission Valley. In addition, Mr. Chaboudy taught tennis
at Southwestern Community College for over ten years and has taught at the
Tennis Center for the past two years. He is active in the San Diego Tennis
Patrol Association and organized and keeps active in a local social tennis
club of forty men and women. Attached is Mr. Chaboudy' s resume and proposal .
The City negotiated an agreement with Mr. Chaboudy for the operation of the
Tennis Center. The major points of the agreement are:
1 . Pro-Shop - Stocking of tennis related merchandise for resale will be at
the operator's discretion.
2. Utilities - The City will continue to assume all utility charges except
for telephone services.
3. Term of Agreement - Three years commencing on December 1 , 1985, and
terminating on December 1 , 1988.
4. Hours of Operation - Minimum Hours of Operation will be Monday through
Saturday, 9:00 a.m. to 5:00 p.m.
5. Lease of the facilities will be for a period of three years.
6. The Tennis Professional will operate all concessions as an independent
contractor and shall purchase and pay for all materials and merchandise
used or sold in the operation of that concession.
7. The Professional shall provide necessary materials and personnel at his
own expense to adequately cover the operation of the City-owned tennis
pro-shop and four tennis courts during the hours of operation as agreed
upon during negotiations.
8. Program responsibilities assumed by the Tennis Professional shall include:
a. Instruction - individual and group lessons
b. Conducting three areawide open tennis tournaments annually.
c. Promoting a citywide youth tennis program.
9. The Tennis Professional shall be required to clean the four City-owned
tennis courts daily before 9:00 a.m. and wash said courts every Friday
before 8:00 a.m.
10. The Professional shall provide all maintenance, repair and service
required on all equipment used in the pro-shop.
11. The Professional shall be required to provide a policy of public liability
and property damage approved by the City Attorney

12. The Professional shall furnish and install at his own expense in the
tennis pro-shop building all necessary furniture, furnishings and
equipment required in order to render sufficient and adequate service as
determined by the City.
13. It is expressly understood and agreed that the Professional may not sign
or transfer any of the rights, license or privileges or any part thereof
contained in this agreement without the written consent of the City
Council .
14. Payment for Services - The Tennis Professional will receive payment for
his services in the form of the following.
a. All revenues received from the lease of tennis equipment.
b. All revenues from tennis lessons.
c. All revenues from sales at the pro-shop.
d. All revenues from repairs of tennis equipment.
e. All fees collected at the tennis complex shall be the exclusive
property of the Professional .
FISCAL IMPACT: Revenues generated from the meter tennis courts will pay for
all electrical cost of tennis center. The cost of daily court maintenance
will be assumed by the tennis professional .

III Proposed Program:

using the latest innovations and developement of
techniques as outlined by the United States
Professional Tennis Association.

3. A minimum of three (3) area tournments will be
scheduled each year.
4. The Professional , with the Parks and. Recreation
Department , will coordinate a summer program for
juniors.
5. The Professional will work closely with the tennis
community as represented by the Chula Vista Racquets
Club and The Naughty Netters Tennis Club.
6. The Professional will operate the Chula Vista
Tennis Center with personal as well as professional
interest to insure proper maintenance and security
during the hours of operation.

Prices will be competitive with other area
Professionals. Presently:

9.00 per half hour - juniors
