HomeMy WebLinkAboutAgenda Statement 1985/10/22 Item 7 COUNCIL AGENDA STATEMENT Item 7 Meeting Date 10/22/85 ITEM TITLE: Resolution / /.S Approving an agreement with EastLake Development Company for construction of sewers SUBMITTED BY: Director of Public Works/City Engineer REVIEWED BY: City Manager 7% (4/5ths Vote: Yes No X ) In order for EastLake to meet a spring model opening date, a request has been made to construct sewers in certain streets prior to final map approval. For this to occur or if it is to occur, it would be necessary for them to enter into an agreement that would absolve the City of any risk as well as post the normal bonds. RECOMMENDATION: That the City Council approve the resolution approving the agreement for advanced installation of sewers. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: Council approved the tentative map for EastLake I Residential in February 1985. Shortly after that staff approved a mass grading plan for EastLake to begin their work. Since then, staff has been plan checking both the rough grading plan and the public improvement plans for the backbone street system. The normal process for a subdivision is for the public improvement plans to be completed along with the final map which is approved by the City Council . With the approval of the final map, the subdivision improvement agreements with the appropriate security are also submitted. The improvement plans for each street include the street improvements, street lights, water lines, sewer lines, and storm drain facilities, all on the same sheets. At this point, EastLake's plans are not to the point where they can be finally approved by the City Engineer for facilities, although we have approved the sewer element of the plans. Since the final map is not ready for approval by the City Council , the final subdivision improvement agreement has not been prepared. The proposed interim agreement calls for the developer to obtain a separate permit for the construction of the sewer line with the appropriate bonds and agreements. It also provides that should the final improvement plans change to an extent great enough to require a change in the sewer line, the developer agrees to make the changes to the sewer line at his sole cost. The agreement further provides that a permit to construct these sewers does not guarantee or obligate the City to accept or maintain them. The instrument that would complete that agreement would be the final map whereby the City would accept the rights-of-way and improvements for maintenance. Page 2, Item 7 Meeting Date 10/22/85 In the event that this agreement is not approved, the construction of the subject sewers would not be possible until the final map to Unit 1 is approved. That may not occur for 1 or 2 months from now, and the planned opening of the project may be delayed because of that schedule. We believe that the agreement and the current status of the street rights-of-way as private property will protect the City from assuming liability for these improvements. Staff is very concerned that this action of approving portions of plans ahead of oir normal,:.proces;s world b:ecargre a precedent. Due to staff shortages and extremely high workload, the plan checking process has taken much longer than originally estimated by staff.
