HomeMy WebLinkAboutAgenda Statement 1985/10/15 Item 13 COUNCIL AGENDA STATEMENT Item 13 Meeting Date 10/15/85 ITEM TITLE: Resolution fa/0245f Approving an amendment to the Subdivision Improvement Agreement for Chula Vista Tract 81-4, Bonita Long Canyon Estates - Unit 1 SUBMITTED BY: Director of Public Works/City Engineer Q REVIEWED BY: City Manager g' (4/5ths Vote: Yes No X ) On April 16, 1985, the Final Map and Subdivision Improvement Agreement for Bonita Long Canyon Estates - Unit 1 , located at the northwest quadrant of East "H" Street and Corral Canyon Road, was approved by the City Council by Resolution 11993. An amended Subdivision Improvement Agreement is now before the City Council for approval . RECOMMENDATION: That Council adopt the resolution approving the amendment. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: McMillin Development, Inc. was made responsible for the construction of the north half of East "H" Street from Otay Lakes Road easterly to Corral Canyon Road by the Conditions of Approval of the Tentative Map for this project. In the last few months, McMillin has entered into an agreement with EastLake Development Company whereby McMillin's contractor will construct the entire improvements for the 100-foot right-of-way of East "H" Street. McMillin has requested the City to amend the existing Subdivision Agreement to separate the offsite improvements within East "H" Street and Otay Lakes Road from the improvements within the project boundaries. Since construction has begun on these streets and will be completed shortly, it is believed not necessary for McMillin to furnish full bonds for the construction. However, it is necessary for McMillin to furnish three guarantee bonds (15% of construction costs) guaranteeing the workmanship and materials of East "H" Street and Otay Lakes Road for a period of one year. The guarantee bond for the easterly portion of East "H" Street from the westerly boundary of Bonita Long Canyon to Corral Canyon Road is $79,000. The guarantee bond for the westerly portion of East "H" Street from Otay Lakes Road to the existing street improvements is $65,400. The guarantee bond for that portion of Otay Lakes Road (about 1 ,000 feet long) north of East "H" Street is $19,700. The sum of the three bonds is $164,100. The proposed amendment will allow us to accept these offsite im• • - separately from the improvements within the subdivision af(2/ 4-41-Z," '"'"e--- —.,_._ �.•s,, , , ,;ii of ✓ om /! ...;1; v . . t � .1,*villa ii Page 2, Item 13 Meeting Date 10/15/85 Council has expressed an interest in opening East "H" Street to public use at an early date in order to relieve residential streets in the area of Bonita-Long Canyon of traffic by suppliers and construction workers. The posting of separate guarantee bonds for the improvements will allow this to be accomplished. Staff presently expects the improvements to be completed during the current week (October 14-18). It should be noted that the acceptance of potential liability arising from public use of these streets will create no greater responsibility for the City than does the acceptance of any other public street. The difference in this situation is simply that all cleanup work may not have been completed by the time the street is opened. Traffic on these streets will be mostly due to existing uses and travel patterns. Because of this situation, staff believes that the City' s acceptance of the potential liability associated with use of the facilities is appropriate. Council also requested a report on when Rutgers would be constructed between "H" Street and Gotham. It was felt that project would reduce traffic problems on Gotham Street. It is my understanding that that road will be constructed, two lanes wide, and be completed within four to five months. Preliminary grading plans were approved last week.
