HomeMy WebLinkAboutAgenda Statement 1985/10/15 Item 9 COUNCIL AGENDA STATEMENT Item 9 Meeting Date 10/15/85 ITEM TITLE: Consideration of the proposed "Bonita Road/Plaza Bonita Road Reorganization" Resolution / 4 61 O Approving the "Bonita Road/Plaza Bonita Road Reorganization" SUBMITTED BY: Director of Planning (4/5ths Vote: Yes No X ) REVIEWED BY: City Manager 0' On November 13, 1984, the City Council by Resolution 11824 initiated the "Bonita Road/Plaza Bonita Road Reorganization" involving the annexation of approximately 4.2 acres of vacant uninhabited territory to the City of Chula Vista and the concurrent detachments from the Bonita-Sunnyside Fire Protection District and San Diego County Flood Control-Zone 3. The application for the proposed reorganization proposal was filed with LAFCO on November 15, 1984. On September 9, 1985, the Local Agency Formation Commission adopted Resolution R084-29 approving the proposed reorganization. RECOMMENDATION: That Council adopt a resolution approving the proposed "Bonita Road/Plaza Bonita Road Reorganization" involving the annexation of approximately 4.19 acres of unincorporated uninhabited territory to the City of Chula Vista and the concurrent detachments from the Bonita-Sunnyside Fire Protection District and San Diego County Flood Control-Zone 3. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: General Description of the Proposal Area The proposal area is a vacant, narrow strip of territory located at the northeasterly quadrant of I-805 and Bonita Road as well as along the southerly side of Plaza Bonita Road. Plaza Bonita Road is not included within the boundaries of the annexation. The subject area is contiguous to the existing City boundary on its southerly and westerly sides. The County of San Diego, owner of the subject territory has considered it to be surplus land from the Sweetwater Regional Park and has consented to the proposed annexation to the City of Chula Vista which can better serve the property. ,..._ __rra i or l.,hr1 .e 1Yi.:C.e tf ti1ror rile Dated /6r._ Page 2, Item 9 Meeting Date 10/15/85 Environmental Review A Negative Declaration issued on the Initial Study (IS-31 ) was adopted by City Council on November 13, 1984. No further action is required. General Plan/Prezoning The County's Sweetwater Community Plan designates the territory as 24-impact sensitive (1 dwelling unit per 4, 8 and 20 acres). The County zoning is A-70 (Limited Agriculture). The Chula Vista General Plan designates the territory a Parks and Open Space and Visitor Commercial and has been prezoned A-8 (Agricultural 8 acres minimum) and C-V-P (Visitor Commercial subject to a Precise Plan). Delivery of Municipal Services The City's Public Works, Police and Fire Departments have indicated that comprehensive municipal services can be provided without an increase in personnel and equipment. FISCAL IMPACT: Since the property is owned by the County of San Diego, there are no tax revenues received; however, if sold to private interests the territory will be required to participate in the retirement of the 1970 Chula Vista Police Facility Bonds. The traffic signals will continue to be maintained by the County of San Diego; however, the City of Chula Vista will be required to pay one-fourth of the energy and maintenance costs which may be approximately $1000 to $1200 annually. WPC 2192P THE SAN DIEGO LOCAL AGENCY FORMATION COMMISSION , HAS ADOPTED A RESOLUTION APPROVING THE "BONITA ROAD/PLAZA BONITA ROAD REORGANIZATION" (CITY OF CHULA VISTA) The following filings to be made after the conducting authority has ordered the change (s) of organization (boundary change (s) ) must be pro- cessed by the LAFCO office: 1 . County Recorder 2 . County Assessor 3 . County Surveyor 4 . County Auditor 5. State Board of Equalization Any other filings remain the responsibility of the conducting authority. Proceedings must be initiated within 35 days after adoption of the Com- mission ' s resolution, and completed within one year after LAFCO approval , or the proposal must be considered abandoned (Calif. Govt . Code Sects . 35201/54799 . 2/56292) . If your Board/Council adopts a resolution/ordinance ordering the boundary. change (s) , the following materials must be forwarded to the LAFCO office : 1 . Six (6) certified copies of the resolution/ordinance, includin x the anprcved legal description and man, with original signa- tures on each certification page. If a reorganization is involved , send sufficient additional copies to furnish one to each other affected agency. 2 . Certificate Re : Terms & Conditions and Indebtedness ( e attached form) . Please return sinned, original copy. 3. State Board of Equalization fee in the amount of $ 160_ . 00 (make checks payable to "State Board of Equalization" ) . NOTE: Filings received in the LAFCO office after November 15 and to be filed by December 31 must include an additional 105 , as required by ;Section 3 (f) of the State Board of Equalization Schedule of Processing Fees effective July 1 , 1 ) 4 . The ExecutiveOfficer will check all documents for compliance before filings are made. Amendments to the LAFCO resolution, including boundary modifications , can only be made by the Commission. All documents re- corded and copies of letters of acknowledcment will be returned to the conducting authority. No. : R084-29 RESOLUTION OF THE SAN DIEGO LOCAL AGENCY FORMATION COMMISSION APPROVING A PROPOSED REORGANIZATION INCLUDING ANNEXATION TO THE CITY OF CHULA VISTA AND DETACHMENT FROM THE BONITA-SUNNYSIDE FIRE PROTECTION DISTRICT AND THE SAN DIEGO COUNTY FLOOD CONTROL DISTRICT "Bonita Road/Plaza Bonita Road Reorganization" On motion of Commissioner Hostler, seconded by Commissioner Mahr, the following resolution is adopted: WHEREAS, -a resolution of application was submitted to this Commission for the reorganization of territory including annexation to the City of Chula Vista and detachment from the Bonita-Sunnyside Fire Protection District and the San Diego County Flood Control District, which resolution was adopted by the City Council of Chula Vista as Resolution No. 11824, dated November 13 , 1984, pursuant to the District Reorganization Act of 1965 (Government Code Section 56000, et seq. ) ; and WHEREAS, the territory proposed for reorganization is as described in the application on file with the Local Agency Formation Commission; and WHEREAS, all owners of land have consented in writing to the reorganization; and WHEREAS, the Executive Officer of the Commission has filed her report on said reorganization, which report was received and considered by the Commission; NOW THEREFORE, BE IT RESOLVED, that this Commission hereby finds, determines, and orders as follows : (1 ) The Commission certifies that it has reviewed and considered the information contained in the Negative Declaration prepared by the City of Chula Vista. ( 2 ) The Commission hereby approves the reorganization with modified boundaries, as described in Exhibit A attached hereto . ( 3 ) The boundaries of the territory as described in Exhibit A are definite and certain. (4) The boundaries of the territory do not conform to lines of assessment and ownership. ( 5 ) The territory includes 4. 19 acres and is uninhabited . / (6) The territory proposed to be reorganized is iereby designated the "Bonita Road/Plaza Bonita Road Reorganization" (City of Chula Vista) . ( 7) The Commission hereby designates the City of Chula Vista as the conducting authority and authorizes the City Council to initiate proceedings in compliance with this resolution without notice and hearing.
