Approving Housing Cooperation Agreement with Richard Zogob for affordable senior housing units SUBMITTED BY Community Development Director ,(4/5ths Vote: Yes No X ) REVIEWED BY: City Manager 0 On October 25, 1983, the City Council approved Conditional Use Permit No. PCC-83-24 which provided for the development of a 13-unit senior rental housing project at 411-415 Park Way by Richard Zogob. The project was subject to the Senior Housing Development Policy conditions for low income senior benefit for such density bonus conditional use permits, and the conditions of the Senior Housing Development Policy were memorialized in a Housing Cooperation Agreement signed by Mr. Zogob and to be approved by the City Council prior to building occupancy. The agreement has not been approved by the City Council . RECOMMENDATION: That the City Council adopt the resolution approving the Housing Cooperation Agreement with Richard Zogob controlling occupancy of the 13-unit residential rental project at 411-415 Park Way. BOARDS/COMMISSIONS RECOMMENDATION: The project was reviewed and endorsed by the Commission on Aging on October 12, 1983. DISCUSSION: The Housing Cooperation Agreement, to be approved by the City Council and recorded against the property to run with the land, articulates the conditions for low income senior housing benefit and the mechanisms for monitoring compliance. The conditions are as follows: 1 . Tenants be 60 years of age or older. 2. Tenants' income must be at or below 80% of median income. 3. Tenant income be certified. 4. Rental rates be at or below applicable Section 8 Fair Market Rents levels. 5. The above conditions apply for a period of 25 years. This Housing Cooperation Agreement is substantially the same as others entered into by the City Council for other Senior Housing Development Policy projects. by tie Cii:`: of Chula ■ i;A , C.x<< ornia Dated /e' — �°—�s Page 2, Item 10 Meeting Date 10/1/85 The Housing Cooperation Agreement should have been approved by the City Council and recorded prior to occupancy of the project. Neither action was taken, an oversight which has just been discovered. The project has been occupied for several months. However, the property owner has been operating under the terms of the Housing Cooperation Agreement which he signed. Tenancy records have been reviewed by staff, and the project has been found to be in total compliance. Approval of the Housing Cooperation Agreement and its recordation will assure that successors to the owner will be aware of and bound by the benefit stipulations. FISCAL IMPACT: Not applicable. REMARKS AND DETAILS: Change in contract at agreed price as follows: 1. Installation of interconnect cable at Bonita Road from Flower Street to I- 805 southbound on-ramp. The agreed price of $2,328.92 is considered to be the full cost for furnishing all tools, labor, material and equipment for the installation of the signal interconnect cable (SIC type) at Bonita Road from Flower Street to I-805 southbound on-ramp (about 1600 lineal feet) and no additional compensation nor time extension will be due. Cable shall conform to attached specifications and as shown on the revised plans.
