HomeMy WebLinkAboutReso 1990-15922 RESOLUTION NO. 15922 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ACCEPTING THE RESULTS OF A MAIL-IN ELECTION HELD ON OCTOBER 9, 1990 AND ADOPTING NEGATIVE DECLARATION FOR IS-90-32 The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City Clerk's office conducted a mail-in election on October 9, 1990, for the parcel owners of the Bonita Ridge Estates ~2, Open Space District #4, for the purpose of obtaining authorization for the City to sell open space property deemed eligible for sale under the City Grading Deviation Policy; and WHEREAS, the City adopted the "Grading Deviation Policy" on September 23, 1986, for the purpose of providing the procedures and criteria to be used to identify and to sell City dedicated open space property for the specific purpose of correcting grading deviations made at the time of subdivision development; and WHEREAS, the City received an application from a resident at 1311 Ridgeview Way to purchase eligible open space property; and WHEREAS, a simple majority support of homeowners voting in the Open Space District via a mail-in election was required; and WHEREAS, the mail-in election was conducted with the results tabulated on October 9, 1990 by the City Clerk; and WHEREAS, a total of 208 ballots were mailed on October 1 to the parcel owners in Open Space District #4 and the results were: 1. Total number of votes cast 89 2. Total votes in favor of sale 46 3. Total votes against sale 43 WHEREAS, upon acceptance of the mail-in ballot by Council, the procedure requires hiring of an independent real estate appraiser to appraise the value of the land and upon Council acceptance of appraisal and Council's approval of sale, the property exchanges ownership and proceeds from the sale are credited to the respective open space districts reserve fund. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby accept the results of a mail-in election held on October 9, 1990. Resolution No. 15922 Page 2 BE IT FURTHER RESOLVED that the City Council does hereby adopt IS-90-32 which determined that the project will not have a significant environmental impact and no evironmental impact report needed to be prepared.
