ITEM TITLE: Resolution /q/C(Accepting public improvements, Kimball
Terrace Subdivision

C. E. Norcross, Subdivider, completed the public improvements for Kimball
Terrace Subdivision in May of 1984. A final inspection was made on
September 5, 1985. The Public Improvement Agreement was approved by Council
Resolution 11151 , dated February 1 , 1983.
RECOMMENDATION: That Council :
1 . Accept the public improvements for Kimball Terrace Subdivision.
2. Declare that the intent of the one-year bond of guarantee of material and
workmanship has been fulfilled due to the time lag between construction
and this acceptance and that posting of the bond is not required.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
C. E. Norcross through his contractor, Jessie Helton, completed the public
improvements for Kimball Terrace in May of 1984. The contractor, Helton,
began construction of units on the property. Due to an unknown problem, the
contractor was discharged by Mr. Norcross who completed the building
construction. Mr. Norcross is now requesting release of letters of credit
submitted as surety to guarantee construction of the public improvements.
The inspection of the public improvements found them to be in accordance with
the plans and specifications and to the satisfaction of the City Engineer.
The improvements consisted of 321 lineal feet of curb and sidewalk along with
pavement overlay on Third Avenue and one street light.
The Subdivision Ordinance requires that upon acceptance of the public
improvements, the developer will post a 15% surety bond to guarantee the
public improvements against defects of material and workmanship for a period
of one year after the date of acceptance of the public improvements. Due to
the fact that these improvements were completed in May 1984 and no
deficiencies have appeared, it is recommended that the City Council declare

that the intent of 15% surety bond has been satisfied and accept such public
improvements without the bond being posted. Should the City decide that the
15% surety bond must be posted, it will be necessary for C. E. Norcross to
post a bond in the amount of $1 ,800.00 to guarantee the public improvements as
to material and workmanship for a one-year period following acceptance of the
improvements.
FISCAL IMPACT: City will assume maintenance responsibility for the public
improvements.
