RECOMMENDATION: Adopt the Resolution BOARDS/COMMISSIONS RECOMMENDATION: N/A DISCUSSION: AB 1427 would invalidate the existing legal right of general law cities to impose a transient occupancy tax (TOT) upon overnight users of state parks. The bill is applicable only to general law cities and will not impact Charter cities. Currently, the bill would affect only five coastal cities: Pismo Beach, Morro Bay, Carlsbad, Half Moon Bay and Carpinteria. The bill is inequitable in that it allows for TOT on private RV parks, but not on competing public parks. It allows campers in public parks to take advantage of City services without requirement of payment through TOT for funding of these services. The League of California Cities has taken a position in opposition to this bill for these reasons and has recommended that cities express their opposition.
