HomeMy WebLinkAboutAgenda Statement 1985/08/20 Item 15 COUNCIL AGENDA STATEMENT Item 15 Meeting Date 8/20/85 ITEM TITLE: Resolution / / /'Revising Condition No. 17, Charter Point Subdivision SUBMITTED BY: Director of Public Works/City Engineer REVIEWED BY: City Manager (4/5ths Vote: Yes No X ) At the Council meeting of August 13, 1985, Council adopted the Resolution of Necessity for acquiring Telegraph Canyon Road adjacent to Charter Point Subdivision. The developer has only been allowed to receive occupancy permits for 220 of the 274 units in the subdivision. He has requested release of more units since the right-of-way action has been agreed to by the Council . RECOMMENDATION: Approve resolution modifying Condition No. 17. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: Resolution No. 10276 approved the tentative map for Charter Point Subdivision. Condition No. 17 of that resolution required temporary off-site improvements to be constructed prior to Unit No. 2 of the subdivision being occupied. That resolution has been modified several times to release more units and to change the conditions so that a divided highway will be built in front of Charter Point Subdivision in lieu of the temporary off-site improvements. Resolution No. 11591 revised Condition No. 17 by allowing the occupancy of up to 220 units prior to the public improvements being installed.
