On May 28, 1985, the City Council passed Resolution 12032 awarding a contract to Klaser Tile
:ompany in the amount of $97,556.38 to remove and replace the tiles in the Civic Center
Plaza. Change Order No. 1 is determined to be necessary to provide a sound project that
Dill make the contractor liable for a long, lasting job.
RECOMMENDATION: That Council authorize:
1 . Appropriating necessary funds from the Revenue Sharing Contingency Fund.
2. Approve Change Order No. 1 .

DISCUSSION:
rlhen the plans were developed to remove and replace the tiles additional expansion joints
)ver and above those noted in the existing plans were included to prevent future breaking
)f the tiles due to contraction and expansion of the concrete mass. The contractor when
laying out the expansion joints shown on the plans discovered that the original expansion
joints noted on the plans as existing, were in fact not true joints. The contractor was
in touch with Greg Mowat of the Ceramic Tile Institute to advise him of the problem. The
:ontractor was advised that without the expansion joints noted on the original plans and
:he new plans, the project would not meet the recommendations of the Ceramic Tile Institute.
;pecification EJ711-85 (the industry standard) . Consequently, Klaser Tile Company sent a
letter to the City informing us that they could not assume the liability for a long lasting
:ile installation.
The tile in the circle surrounding the fountain was not called out to be replaced.
nspection of the tile prior to plan preparation, and again during the pre-bid site
nspections revealed that the tile was in good condition. However, the contractor in his
nspection prior to beginning installation found some hollow spots with raised tiles at
our separate locations in this area. It was at first considered that repairs be made
only to these specific areas but the new tiles are a different color and would not be
;ompatible. It is also highly likely that due to the high degree of differential expansion
'esulting from hot mid-day and cool evening temperatures and the constant wind blown water
list from the fountain, there are probably even more partially raised tile than are realized.
t is therefore deemed necessary and recommended that we replace all of the tile in the
ircle area at the base of the fountain. The new circular expansion joint around this area
s designed to prevent further damage there.

A contract for $94,785 was awarded to Klaser Tile Company. Funds approved by
Resolution 12032 on May 28, 1985 for the Civic Center tile replacement project
total cost of $97,556.38, including $2,771 .38 contingency.

contract, that sufficient monies to meet the obligations of the
contract are actually in the Treasury, or are anticipated to come
into the Treasury to the credit of the appropriation from which
the same are to be drawn, and that said monies now actually in
