An investigation into the matter revealed the signs were installed by Sun Cal Outdoor Advertising for Pacific Scene' s "Summer Ridge" and "Pacific Ridge" developments. Pacific Scene was directed by this department to remove the signs or apply for an encroachment permit. The latter was opted for and a request was submitted by Sun Cal. The request must be considered by the Council before issuance of the permit may take place. RECOMMENDATION: That the Council adopt the subject resolution approving the encroachment permit with conditions as stated in this report. BOARDS/COMMISSIONS RECOMMENDATION: No Commission action is required on this matter. However, Planning Department staff has concurred with the approval of the signs with certain conditions as contained within the discussion of this report. DISCUSSION: Recently, it was noted that two signs had been installed in the City's right-of-way on the northeast corner of Telegraph Canyon Road and Paseo del Rey. One was advertising "Summer Ridge" homes and the other "Pacific Ridge" homes. Both of these projects are being developed by Pacific Scene, Inc. The developer was notified of the encroachment by letter from this office dated June 12, 1985. Thet were advised to either remove the signs or request permission to maintain the signs in the City right-of-way. In response to the letter, Sun Cal Outdoor Advertising, installer of the signs, submitted an application for an encroachment permit. The request was reviewed by the Planning Department staff. They found the location of the signs acceptable with the following comments. Dated ___ _._______._____. Page 2, Item 6 Meeting Date 8/13/85 1 . The signs should be lowered to provide 48 inches from the bottom of the signs to ground level instead of the present 66 inches. 2. The post support should be 2" x 12" instead of the existing 2" x 8". Mr. Cliff McCain, Lease Manager of the Sun Cal , states the signs should not be needed for more than a year. The Council approved Encroachment Permit No. PE024 in September 1983 for a similar type of encroachment at the same location. It was granted to Al Wylie Associates for a directional sign to model homes for El Rancho del Rey, Unit #6. That sign has since been removed. The new signs are not creating a traffic hazard by blocking sight distance at the intersection. I recommend approval of this permit with the conditions recommended by the Planning staff plus the following conditions: 1. The permit shall expire one year from the date of issuance. 2. The City right-of-way shall be restored to its original condition upon removal of the signs. I also recommend that the Council authorize staff to issue an extension of one year to the permit, should the signs still be necessary after the first year. FISCAL IMPACT: None JWH:nr/PE057 WPC 1599E
