SUBMITTED BY: Community Development Director REVIEWED BY: City Manager It. &-y (4/5ths Vote: Yes No X ) In accordance with Title 14 of the California Administrative Code (California Coastal Commission) the effective date of certification of a Local Coastal Program resulting in the transfer of coastal development review authority to the City of Chula Vista occurs after the City complies with several requirements. The following report discusses those requirements, provides a status report of the City's progress, and recommends actions. RECOMMENDATION: That the City Council : 1 . Adopt the attached resolution acknowledging receipt of the California Coastal Commission' s Resolution of Certification of the Chula Vista local coastal program, and adopting coastal permit documents; and 2. Authorizing the Mayor to forward the attached letter and procedures to the Coastal Commission requesting permit authority for the Coastal Zone as outlined in the certified Chula Vista Local Coastal Program. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: Coastal Commission staff has verified that the following must occur prior to transfer of permit authority to local jurisdiction: The City of Chula Vista must acknowledge receipt of the Coastal Commission' s Resolution of Certification including any terms or modifications which may have been suggested for final certification, accepts and agrees to any such terms and modifications and takes formal action to satisfy the terms and modifications and takes formal action to satisfy the terms and modifications. Also, the City must agree to issue Coastal development permits for the total area included in the certified LCP. by the City Chula .rt';i fa t e t /. �-° Page 2, Item 8 Meeting Date 8/6/85 A resolution of acknowledgment is attached for your consideration which will meet this requirement. It states that the City: (1 ) acknowledges receipt of the Commission Resolution of Certification, and (2) adopts procedural documents in compliance with the coastal permit procedures set forth in the Chula Vista Bayfront Specific Plan for the issuance of coastal development permits. (These procedures and documents will be integrated into the Bayfront Procedures Manual which will be presented to the Redevelopment Agency on August 19, 1985.) In addition, the Executive Director of the Commission must determine in writing that the local governments' action and the notification procedures for appealable development are legally adequate to satisfy any specific requirements set forth in the Commission' s certification order. Procedures for the City's issuance of coastal permits and application, notice and accessory forms as proposed above will be forwarded to the Executive Director of the Coastal Commission for review. If found adequate to satisfy Commission requirements, the Director will report his determination to the Commission at its next scheduled public meeting. Finally, a notice of the certification of a local coastal program shall be filed with the Secretary of Resources Agency for posting and inspection. This will be done by the Commission staff after the Commission adopts findings for approval of the implementing ordinances which is scheduled for the September 25-27 Coastal Commission agenda. Once the above items are completed, the City should be authorized to process coastal development applications for areas which fall under appeal jurisdiction on the final post certification map. The Commission staff will continue to process applications in areas designated as original permit jurisdiction (i .e. , lands below the mean high tide line, lands of public trust).
