Ordinance /,, Amending Section 19.58.147D. of the Municipal Code to require a 1 ,200 ft. separation between large family day care homes on the SECOND BREADING AND ADOPTION SUBMITTED BY: Planning Director (0AL (4/5ths Vote: Yes No X ) REVIEWED BY: City Manager On May 14, 1985, the City Council adopted an ordinance establishing standards for large family day care homes in single family zones and directed that the standard regarding separation between such facilities be brought back for further consideration. RECOMMENDATION: That Council enact an ordinance amending Section 19.58.147D. of the Municipal Code to read as follows: "D. DISCUSSION: The standards for large family day care homes (those serving from 7 to 12 children) were adopted in response to State legislation which hich now plows bits the exclusion of these homes from single family zones, application of certain "reasonable" local standards concerning spacing and concentration, traffic control , parking and noise control . One of the standards recommended by staff and adopted by Council was the requirement that large family day care homes be located no closer than 500 ft. from one another. In the staff report it was stated that any figure may appear arbitrary, but that a 500 ft. separation standard would not be and unreasonable in terms of occur addressing here two or more large family traffic, dayp care homes noise impacts which could are located in close proximity to one another. Page 2, Item 4 °l`° Meeting Date 7-741-fih35 7- 25— Of the three other jurisdictions within the region which have adopted local standards for large family day care homes, the County requires no separation, National City requires a 330 ft. separation, and Carlsbad requires a 1 ,200 ft. separation on the same street. National City' s standard is purportedly based on the length of their average city block. In Chula Vista, 1 ,200 would represent the approximate distance between major lettered or numbered streets such as the distance from "E" Street to "F" Street or Fourth and Third Avenues. At the May 14 meeting, Council expressed some interest in adopting a separation requirement similar to that applied in Carlsbad. Limiting large family day care homes to no more than one every 1 ,200 ft. on the same street would certainly provide neighborhoods with an added degree of protection from the potential for adverse traffic and parking impacts.
