ITEM TITLE: Resolution 42--//6 Accepting sewer, drainage, access, street
tree, street right-of-way and sidewalk easements in Palomar
Village Commercial Complex

As part of the development of Palomar Village, the owner is required to
dedicate certain easements to the City. The grant deeds for these easements
have been executed by the owner and are now ready for acceptance by the
Council.
RECOMMENDATION: That Council adopt the subject resolution accepting the
easements and direct the City Clerk to file the grant deeds with the County
Recorder' s office.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
Genesis Development Corporation, owner of the property on the north side of
Palomar Street just east of the MTDB railroad tracks, has submitted
development plans for review by the City. As part of this development (called
Palomar Village) several different easements are required to be dedicated to
the City.
Sewer Easement
An eight-inch sewer main is being installed approximately midway between the
east and west boundaries of the project. It extends from Oxford Street on the
northerly boundary 506 feet to the south. The easement is 15 feet wide.
Street Easement
Currently, Palomar Street right-of-way extends only 30 feet north of the
centerline. To reach an ultimate total width of 102 feet, we are requiring a
strip of right-of-way dedication 21 feet in width north of existing
right-of-way line along the entire frontage of the property.
Storm Drain Easement
The proposed drainage situation calls for a curb inlet on the south side of
Oxford Street, south through the property and continuing south across Palomar
Street. In any case where the drainage facilities are carrying water
collected from public streets, we require an easement to assure proper
maintenance of the system. This easement is 12 feet wide.
Item 13
Street Tree Easement ' t 7/23/85
In order to maintain street trees, we are requiring the dedication of 5-1/2
feet beyond the proposed, ultimate right-of-way line along the north side of
Palomar Street.
Sidewalk Easement
In order to install handicap ramps in the returns at the main entrance off of
Palomar Street, additional right-of-way is needed. This easement extends 15
feet north of the ultimate, proposed right-of-way line and 90 feet along the
frontage on Palomar Street.
Access Easement
In order to maintain traffic signal facilities at the main entrance to the
project, the City needs access to these facilities. The description of this
easement is identical to the sidewalk easement above.
The grant deed forms have been executed by the owner and the legal
descriptions have been checked by this department and have been found
acceptable. They are ready for acceptance and recordation.
A transparency is available for Council viewing.
