ITEM TITLE: Resolution a) Accepting bids, appropriating funds,
and awarding contract for "Construction of Street and Drainage
Improvements in Las Flores Drive and "D" Street between Second
Avenue and Minot Avenue in the City of Chula Vista,
California", and b) authorizing staff to execute Change Order
#1 for construction of street improvement to provide
additional sidewalk

At 2:00 p.m. on June 19, 1985, in Conference Rooms 2 and 3 in the Public
Services Building, the Director of Public Works/City Engineer received sealed
bids for "Construction of Street and Drainage Improvements in Las Flores Drive
and "D" Street between Second Avenue and Minot Avenue in the City of Chula
Vista, California. " The project includes all work required to construct a
20-foot wide ribbon pavement and enclosed storm drain system including some
curb, gutter and sidewalk, sidewalk ramps and masonry retaining wall .
RECOMMENDATION: That the City Council :
1. Appropriate an additional $10,000 from the unappropriated balance of the
Gas Tax funds.
2. Authorize the expenditure of $306,100.
3. Accept bids and award contract to R. E. Hazard Contracting Co. , San Diego,
in the amount of $277,873.50.
4. Authorize staff to execute Change Order #1 for additional sidewalk
construction.

DISCUSSION:
Bids were received from four contractors as follows:

The low bid by R. E. Hazard Contracting Co. is below the Engineer' s estimate
of $297,332.50 by $19,459 or 6.5%. We have reviewed the low bid and recommend
awarding the contract to R. E. Hazard Contracting Co.
Attached is the Contractor' s Disclosure Statement and designation of
subcontractors.
Included in the contract documents is a section entitled, "Work Beyond Limits
of Contract." The City has revoked seven (7) deferrals of public improvements
previously granted to property owners with developed lots (see Exhibit A)
along Las Flores Drive and "D" Street. The property owners were given a
limited time to construct the deferred improvements consisting of curb,
sidewalk, driveways and shoulder pavement. We anticipate that these owners
will contact the successful bidder for quotations to install their required
improvements in conjunction with the contract work.
As this job progresses, we anticipate that the property owners will enter into
agreements with the City for the purpose of borrowing money from funds
previously budgeted for construction of their deferred improvements.
Should the property owners fail to construct their deferred improvements, we
have reserved the right to increase the contract work to ensure their
installation. If required, we will return to Council with a change order(s)
to construct these improvements from funds previously budgeted. The City
Attorney will be requested to take appropriate legal action to recover the
funds expended by the City.
Future Sidewalk Construction
At the Council meeting of June 18, 1985, the City Council requested some
information about the construction of sidewalk improvements to serve the
proposed developments in the area. Some of this sidewalk will be constructed
with this project. Attached Exhibit A showing the existing sidewalk, the
sidewalk that will be installed during the construction of this project,
sidewalk to be installed by execution of Change Order #1 , and the sidewalk
that is proposed to be constructed as part of the assessment district north of
"D" Street. Also shown on the exhibit is the location of the ultimate
sidewalk facilities to serve the area.
As can be seen on the sketch there are two areas along "D" Street where
sidewalk is not planned to be constructed. One is near Minot Avenue and the
other is going up the hill toward Second Avenue.
Sidewalk was deleted along the north side of "D" Street near Minot Avenue for
the purpose of saving several large mature Pepper trees. The street section
in this area was narrowed and the sidewalk eliminated to accommodate the trees.
The other area along the north side of "D" Street near Second Avenue was
deleted because the existing right-of-way is quite narrow and there presently
exists a retaining wall and garage structure near the existing right-of-way.
Construction of a sidewalk along the north side of "D" Street would require
the installation of a retaining wall and result in a sidewalk only
approximately 4 feet in width. The construction of the sidewalk would require

the removal of a nice row of trees. We estimate that the cost of the wall and
sidewalk would be about $13,000. The cost of constructing our standard 5-1/2
foot wide sidewalk would be considerably more expensive because additional
right-of-way would have to be purchased as well as an existing retaining wall
would have to be rebuilt. We believe this to be an unnecessary expense at
this time and that the sidewalk on the southerly side of "D" Street in this
area will sufficiently serve the needs of the area. However, if the sidewalk
becomes necessary it can be installed at a future date.
Also, sidewalk is not planned to be constructed for a short distance along the
west side of Las Flores Drive near the intersection of "D" Street because of
the close proximity of an existing house.
The completion of this project and construction of the deferred improvements
along with the improvements to be constructed under the future improvement act
district will provide a continuous sidewalk from Second Avenue to all the
proposed development north of "D" Street.
FISCAL IMPACT: Routine City maintenance.
