a TITLE: Resolution 0'6thorizin the City Attorney to file a
written argument regarding the City propositions

The City Council has directed that certain propositions
amending the City Charter be placed on the November 5 , 1985
election. Arguments in favor of the propositions along with
the City Attorney' s analysis will be printed in the sample
ballot brochures.
RECOMMENDATION: Approve the resolution authorizing the City
Attorney to prepare the arguments in favor
of the propositions .
DISCUSSION:
The State Elections Code sets certain deadlines for submittal
and publication of election documents. The City Clerk is
required to set a deadline date for submittal of arguments
for and against the propostions - this must be done no later
than the 82nd day prior to the election - or by August 15 .
Once the arguments for and/or against are received, there is
a 10-day period of time during which the City Clerk must make
available all the propositions, analyses and arguments to the
public. - ,
Sections 4015.5 and 5014 . 5 of the Elections Code authorizes
the City Council by a majority vote , to adopt provisions to
allow the filing of rebuttal arguments for City measures.
In the past, the Council has not authorized rebuttals - it
would be my recommendation that we continue this practice
since none of the measures being submitted are that
controversial.
FISCAL IMPACT: The cost of the election is estimated
at $20 ,000 .
