The Final Map for the Otay Valley Industrial Park was approved by Council on
June 19, 1984. The Subdivision Improvement Agreement was approved at the same
time.
Because of a proposed change in ownership of a portion of this project, the
developer has requested that he be allowed to delay construction of certain
improvements as discussed below.
RECOMMENDATION: That Council approve the amended Subdivision Improvement
Agreement.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
In anticipation of the sale of the northern portion of this subdivision to
SDG&E, the developer, Sammis Properties, has requested that they be allowed to
defer construction of surface improvements within Research Court.
We are advised that SDG&E's plans may include requesting the vacation of all
or a portion of Research Court. This request would be made at such time that
their site planning is complete.
The completion of necessary improvements would take place after any requested
vacation had been considered by Council .
In order to allow the remainder of the subdivision improvements to be
completed and accepted by the City, it is proposed that an amended Subdivision
Improvement Agreement be approved.
Under its terms, Sammis Properties would be allowed to substitute a new
developer for a portion of the project.
Substitute bonds would be posted by the new owner for the portion of work
within their ownership. The City would accept such bonds when advised that a
new party has come into ownership of a specific portion of the property and
the City Eng' ..has assroved an estimate of the cost of remaining
improvements.

Existing bonds would be released when the remainder of the work is completed
and accepted by the City.
The developer has executed his portion of the agreement, which is submitted
for Council consideration and approval .
