ITEM TITLE: Report on Establishing a Community Planning Committee for the Montgomery
Area

At the June 18, 1985 meeting, the City Council directed staff to set a Public hearing
to consider the formation of a community planning committee for the Montaomery area.
Chapter 2.48 of the City Code establishes the regulations governing community planning
committees , and an ordinance amending that Code section which would provide an additional
option authorizing the City Council to commit itself to appointing the top vote getters
in an advisory election is also presented for your consideration. As outlined in the City
Code, the purpose of a community planning committee is to provide a "representative and
responsive voice inthe democratic governmental process by those citizens in areas within
the City (or areas proposed for annexation to the City) which can truly be called dis-
tinctive communities facing problems peculiar to said communities."
The present Code calls for a seven (7) member committee which may be selected either by
an election or appointment by the City Council . While the current ordinance allows
Council to appoint the top vote getters, the proposed amendment would authorize the City
—'uncil to commit to these appointments at the time of the public hearing when the question
formation of the committee is considered. Under all of the options , the members must
be registered voters and would serve for two-year terms. If they are chosen by election,
they must be nominated by a petition signed by twenty electors of the territory.
The primary and initial functions of a community Planning committee is to develop a
community element of the General Plan for the area encompassed by the community planning
committee. In addition, the committee has the power to review and recommend upon precise
community plans, including all land uses , population densities, transportation network
planning, open space, park lands and all other items of a community clan. It also has
the power to review and recommend zoning regulations in terms of the comprehensivelzoning
ordinance, including planned community and planned unit developments, development programs,
and incorporation of properties within the territory of the community planning committee
into particular zones. It also reviews and recommends upon all variances , conditional
use permits , subdivisions, architectural reviews and other regulations affecting land use,
such as animal regulations , etc.
Recommendations of the committee on all variances and conditional use permits, under the
terms of the existing ordinance, may only be overridden by the Planning Commission by an
extraordinary vote of five of the seven members. The ordinance further provides that
the committee is funded by the City and staffed by the Planning and Public Works Depart-
ments. The present ordinance prohibits the Planning Commission or the City Council from
taking any action on any matter within the community planning committee`s charge before
receiving a recommendation from the committee, unless the committee fails to act within
twenty-one days.

affects the Montgomery area. Montgomery residents , notwithstanding how long such a
committee might continue to function, could effectively facilitate the transformation of
Montgomery from an unincorporated area of the County to becoming an important and
integral part of the City of Chula Vista. Residents of the Montgomery community probably
would feel more comfortable during the transition knowing that representatives of their
community are involved in reviewing all proposals which might affect them. The Mont-
gomery planning committee, of course, would require property owners of that area to
face one additional level of review before having their plans approved. While the ad-
vantages may well outweigh this additional delay, this factor, together with the
additional costs involved, is a matter that the City Council will want to weigh during
the hearing process.
The committee's transitional role and immediate availability, following a favorable
annexation vote, is an important factor in favor of the establishment of the community
planning committee prior to the election. Likewise, it is important for the City
Council to contemplate expanding all City boards and commissions to help facilitate the
assimilation of the community into the City and mitigate the long term need for a special
planning committee.
