ITEM TITLE: Public Hearing to consider a request for waiver of
undergrounding requirements for Bonita Long Canyon Subdivision

The developers of Bonita Long Canyon subdivision have requested a waiver of
the requirement to underground the 12KV electrical lines within the boundaries
of that project (see Exhibit A). In accordance with Section 15.32.040 of the
Chula Vista Municipal Code, any such requests must be considered by the
Council at a public hearing.
RECOMMENDATION: That Council :
1. Conduct the subject public hearing.
2. Adopt the subject resolution approving the waiver request.

DISCUSSION:
Background
In accordance with Section 15.32.020 of the Municipal Code, McMillin
Development Company is required to convert the existing 12 KV overhead
electrical facilities to underground within its Bonita Long Canyon subdivision
boundaries. Section 15.32.040 of the City Code provides for a variance or a
deferral of these requirements in certain instances. This variance or
deferral must be considered by the City Council at a public hearing.
After the public hearing, the Council may defer the undergrounding
requirements if the following facts are found to exist:
A. That extraordinary conditions exist to the extent that enforcement of this
requirement would result in unnecessary hardship to the subdivider or the
utility company.
B. That the deferral will not be detrimental to the health, safety or general
welfare of the neighborhood.
On May 26, 1931 , the Council adopted Resolution No. 10469 in which the
Sectional Planning Area Plan for Bonita Long Canyon was approved including
therein the approval of Planning Commission Resolution No. PCM-81-13. Item

No. 13 in the Commission's resolution states: The requirement for
undergrounding the existing 69KV line within the 250-foot wide SDG&E easement
shall be waived.
Findings
The results of an investigation into the matter of this deferral are as
follows:
1. The 250-foot wide SDG&E easement cuts across the project in an east-west
direction through its approximate middle. The easement contains poles
shared by 12KV and 69KV lines and towers supporting 230KV lines.
2. The 69 KV and 12 KV lines extend from the west boundary to the east
boundary within the southerly portion of the easement.
3. The aesthetic benefits gained by undergrounding the 12KV lines would be
minimal as the poles would remain to support the 69KV lines. The large
towers will remain indefinitely.
4. Council approved a similar deferral in 1981 for the developers of Bonita
Haciendas Subdivision which abuts Bonita Long Canyon to the west.
5. The estimated cost submitted by Utility Specialists, Inc. , for the subject
undergrounding is approximately $500,000. (No estimate has been submitted
by SDG&E. )
6. Letting the 12KV lines remain would not pose a threat to the health,
safety or general welfare of the neighborhood.
Based on the findings contained herein, it is recommended that the deferral be
granted. The McMillin Development Co. , Utility Specialists, Inc. , Pacific
Bell , SDG&E, Cox Cable San Diego and property owners within a 300-foot radius
of this project have been notified of the time and place of this public
heari ng.
