HomeMy WebLinkAboutAgenda Statement 1985/06/18 Item 12 COUNCIL AGENDA STATEMENT Item 12 Meeting Date 6/18/85 ITEM TITLE: Urgency Ordi nance /75-- / Ame ndi ng Chul a Vi sta Municipal Code requiring fingerprinting of drivers of public transportation systems operating in the City of Chula Vista 9/41/ SUBMITTED BY: Director of Public Works/City Engineer REVIEWED BY: City Manager (4/5ths Vote: Yes X No ) The City of Chula Vista provides local public transportation service on Chula Vista Transit and HandYtrans. The City of Chula Vista contracts with the South Coast Organization Operating Transit (SCOOT), a joint powers agency between the City of Chula Vista and County of San Diego, for CVT service. SCOOT in turn contracts with a private contractor for CVT operation. The City of Chula Vista contracts directly with a private firm for HandYtrans operation. Under the existing Chula Vista Municipal Code, neither CVT nor HandYtrans drivers are subject to a fingerprinting and background check as a condition of employment. This amendment to the Code would require both Chula Vista Transit and HandYtrans drivers to be fingerprinted as a condition of employment, as are City of Chula Vista employees. RECOMMENDATION: That Council adopt urgency ordinance amending the Chula Vista Municipal Code to require fingerprinting of Chula Vista Transit and HandYtrans drivers. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: CVT and HandYtrans drivers are employees of the respective private firms under contract with SCOOT and the City of Chula Vista for providing public transportation services. Each private operator has its own policies and procedures for screening and hiring drivers, although the private company is limited by law to the extent that a check into a perspective employee' s criminal background through fingerprinting may not be obtained. In addition, since SCOOT and the City of Chula Vista may change contract operators periodically through the competitive bid process, the screening and hiring process for drivers may vary depending on the private operator. Since both CVT and HandYtrans drivers are in constant contact with the public, staff believes that the fingerprinting of drivers of both systems is advisable for the following reasons: - It would be an additional step in the screening and hiring process of driv- ' t .d.i 'on to the •rocedures used by the private operators. 1&, i Chou;a NI iota, ,.;,�,.,a ' Dated - /�- � Page 2, Item 12 Meeting Date 6/18/85 - It would establish consi stency in the screening process regardless of the varying policies of different private operators under contract to either SCOOT or the City. If this ordinance i s adopted by Council , the fingerprinting requirement will d be applicable to Community Transit Services, Inc. drivers on both CVT and HandYtrans, and to all future private operators of both systems. Community Transit Services, Inc. currently is in the process of hiring drivers for CVT to begin service on July 1 , 1985. Although the results of the fingerprinting check would probably not be available before July 1 , adopting an urgency ordinance would expedite this screening process. FISCAL IMPACT: Not applicable.
