Resolution X010 z Approving deferral of undergrounding utilities at 364-368 Park Way SUBMITTED BY: Director of Public Works/City Engineer REVIEWED BY: City Manager(, (4/5ths Vote: Yes No x ) The Chula Vista Municipal Code requires that all overhead utilities within a subdivision to be converted to underground. The owner of the property at 364-368 Park Way is building condominiums at this site and has requested a waiver of this requirement. In accordance with Chapter 15.32 of the City Code, the matter must be considered by Council at a public hearing. RECOMMENDATION: That the City Council hold the subject public hearing and adopt a resolution deferring the undergrounding requirement. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: Mr. Thom Sanders, owner of the property at 364-368 Park Way is building an 8-unit condominium project at that site. According to Section 15.32.020 of the Municipal Code, any existing overhead utilities within the subdivision boundary must be placed underground. Presently, existing are a 12 KV distribution line and a telephone cable running within a 10-foot easement parallel with the rear property line (120 linear feet). The poles are centered approximately 2 feet north of the southerly (rear) property line (see Exhibit A). On May 2, 1985, Mr. Ronald Parker of Phillips-Reynolds Engineering, Inc. , acting as agent for the owner, applied for a waiver of undergrounding requirements. The application form referred to a letter which contained the following reasons for the waiver. 1 . The pole now in the southwest corner of the property would have to be moved 3-5 feet to the neighboring property. 2. No poles would be eliminated by the undergrounding. 3. The possibility exists that another down-pole may be required to serve the property to the south if an easement is not given by the owner of the property to the southwest. Page 2, Item 8 Meeting Date 6/18/85 4. Preliminary estimates for underground: Pacific Bell Telephone $ 2,299.00 SDG&E 15,000.00 (No estimate was submitted for Cox Cable of San Diego) 5. The costs would be prohibitive to the developer. It is not recommended that a waiver be granted in this case. If, in the future, an undergrounding district is formed in this area, this portion of the overhead lines must be converted also. Therefore, a deferral is more in order and is recommended based on the following: 1 . Enforcement of the requirement of the conversion would not benefit the area enough to warrant the expenditure of $17,300 needed to do the work. 2. The lines are at the rear of the property and are hardly noticeable from the street. 3. The deferral , if granted, would not be detrimental to the general health or welfare of the citizens. This portion of Park Way is not listed on any priority list for the formation of an undergrounding district. The existing overhead lines and services will remain definitely. The owner is placing his telephone, cable T.V. and electrical services underground. It is recommended that the Council adopt the resolution approving the deferral with the condition that the owner enter into an agreement with the City to not protest the formation of an undergrounding district should one be formed in the future. The affected utility companies have been notified of this request and are aware of the date of this public hearing.
