Subsequent modification resulted in a report to Council last year which indicated that Charter Point would be responsible for four lanes of Lakes Road which would result in bike lanes, and a median island between Apache Drive and Otay additional right-of-way needed in that location but no right-of-way needed westerly of the telephone company and easterly of transition at Otay Lakes Road. An appraisal has been prepared for this right-of-way and it is now to United appropriate for Council to authorize City sis fa necessaryaaction rthat should Enterprises based upon the app further hearings or negotiations in be authorized by Council prior to any relation to condemnation for the right-of-way. RECOMMENDATION: Approve the resolution authorizing staff to make a "good faith" offer to United Enterprises. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. FISCAL IMPACT: None.
