HomeMy WebLinkAboutReso 1952-1309 • RESOLUTION NO._ 1309 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA CALLING, GIVING NOTICE OF AND PROVIDING FOR THE HOLDING OF A SPECIAL ELECTION WITHIN THE CORPORATE AREA OF THE CITY OF CHULA VISTA FOR THE PURPOSE OF' SUB- MITTING TO THE QUALIFIED ELECTORS THEREOF THE PROPOSITION OF WITHDRAWING FROM THE SAN DIEGO COUNTY WATER AUTHORITY AS A SEPARATE UNIT CONDITIONED UPON THE ANNEXATION OF THE SOUTH BAY IRRIGATION DISTRICT TO SAID SAN DIEGO COUNTY WATER AUTHORITY AND THE METRO- • POLITAN WATER DISTRICT OF SOUTHERN CALIFOR- NIA; ESTABLISHING yTOTING PRECINCTS THEREFOR, DESIGNATING TEE POLLING PLACES THEREOF, AP- • POINTING THE BOARD OF ELECTION FOR EACH ELECTION PRECINCT, DESIGNATING AND AUTHORIZ- ING THE REGISTRAR OF VOTERS OF SAN DIEGO COUNTY, STATE OF CALIFORNIA, TO CONDUCT SAID ELECTION IN ACCORDANCE HEREWITH AND PROVIDING FOR THE CANVASSING OF SAID ELECTION THAT WHEREAS, the City of Chula Vista, a Municipal Cor- poration of the State of California, organized and existing by virtue of the laws s of the State of California; and WHEREAS, the corporate area of the City of Chula Vista is now a part of and included within the San Diego County Water Authority and The Me6ropolitan Water District ' of Southern Cali- fornia;. and WHEREAS, the corporate area of the City of Chula Vista is included within the corporate area of the South Bay Irriga- tim District; and WHEREAS, the South Bay Irrigation District is a state agency, organized and existing by virtue of the laws of the State of California (Division 11, Water Code) , having been duly and completely formed in accordance therewith on March 26th, 1951; and WHEREAS, the Board of Directors of said South Bay Irriga- tion District did, on the 27th day of March, 1951, adopt its Resolution No. 2, requesting the Board of Directors of the San Diego County Water Authority for consent to annex the corporate area of the South Bay Irrigation District to said County Water Authority; and to fix the terms and conditions, if any, for said annexation; and • WHEREAS, the Board of Directors of the San Diego County Water Authority pursuant to its Resolution No. 202, adopted June 21, 1951, applied to the Board of Directors of The Metro- politan Water District of Southern California for .consent to annex to The Metropolitan Water District of Southern California. the corporate area of said South Bay Irrigation District con- currently with the annexation of said corporate area of South Bay Irrigation District to the San Diego County Water Authority subject to terms and conditions to be fixed by the Board of Directors of The Metropolitan Water District of Southern Calif- ornia; and WHEREAS, the Board of Directors of The Metropolitan Water District of Southern California pursuant to its Resolution No. 40l4, adopted October 12th, 1951, granted consent to such annexation subject to certain terms and conditions as therein specified; and WHEREAS, the Board of Directors of the San Diego County Water Authority pursuant to its Resolution No. 212 adopted October 18th, 1951, and its Resolution No. 219, adopted January 17, 1952, and its Resolution No. 227, adopted March 17th, 1952, granted the application and request of the Board of Directors of the South Bay Irrigation District for consent to annex to the San Diego County Water Authority the corporate area of the South Bay Irrigation District and did thereby fix the terms and conditions for such annexation as therein specified; and WHEREAS, the proposed annexation of the corporate area of the South Bay Irrigation District to the San Diego County Water Authority and to The Metropolitan Water District of Southern California is conditioned upon the withdrawal of the City of Chula Vista as a separate unit; and WHEREAS, if such withdrawal by the City of Chula Vista as a separate unit is effected, the corporate area of the City of Chula Vista will remain within said San'-Diego County Water Authority and said The Metropolitan Water District of Southern California, as a part of the corporate area of the said South Bay Irrigation District; and WHEREAS, it is deemed to be in the best interests of the City of Chula Vista that it withdraw as a separate unit from the San Diego County Water Authority condi6b.oned upon the annexation of the South Bay Irrigation District to said San Diego County Water Authority and to The Metropolitan Water District of Southern California effective when said South Bay Irrigation District shall have been finally annexed to said San Diego County Water Authority and to The Metropolitan Water District of Southern California, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CHULA VISTA DOES HEREBY RESOLVE AS FOLLOWS: Section 1. That an election be and it is called within the City of Chula Vista to be held, as hereinafter d4scribed, on Tuesday, the 22nd day of April, 1952, at which election there will be submitted to the qualified voters of the City of Chula Vista the following proposition: Shall the City of Chula Vista withdraw from the San Diego County Water Authority as a separate unit conditioned upon the annexation of the South Bay Irrigation District to said San Diego County Water Authority and to The Metropolitan Water Dis- trict Of Southern California and effective when said South Bay Irrigation District shall have been finally annexed to said San Diego County Water Authority and to The Metropoln Water District YES / Water NO / of Southern California. /---7 That said election is called pursuant to the County Water Authority Act of l943, as amended, and other laws applicable thereto, and as hereinafter pro- vided. Section 2. The polls of said election shall be open between the hours of 7:00 otclook A. M., and 7:00 otelock P. M., and close in the manner provided by law. There shall be four election precincts within the City of Chula Vista, the boundaries of which, polling places in which, and the election officers for which are as follows: PRECINCT NO, 1 shall consist of all of the territory within the boundaries of the City of Chula Vista contained within the following San Diego County general election precincts: CHULA VISTA 1-2.410.»11..12..13 The polling place for said precinct shall be at Chula Vista Fire Station, Recreation Room, 447 F Street, Chula Vista, The officers of election for said precinct shall be as follows: INSPECTOR: Elizabeth Stuesser JUDGE: Juliet E. Rankin PRECINCT NO. 2 shall consist of all of the territory within the boundaries of the City of Chula Vista contained within the following San Diego County general election precincts: CHULA VISTA 3.-4«-5-6..8- 9 The polling place for said precinct shall be at Residence, 380 D Street, Chula Vista. Timmons CLERK: Edith Moe PRECINCT N0%. 3 shall consist of all of the territory within the boundaries of the City of Chula Vista contained within the following San Diego County general election precincts: CHULA VISTA: 7--14.415,-l6--23»24 The polling place for said precinct shall be at Residence, 584 Twin Oaks Avenue, Chula Vista. The officers of election for said precinct shall be as follows: INSPECTOR: Edna M. Cook JUDGE: Lotha R. McGill CLERK: Lois N. Erickson CLERK: Florence M. Smith PRECINCT NO. 4 shall consist of all of the territory within the boundaries of the City of Chula Vista contained within the following San Diego County general election precincts: CHULA VISTA l7-18-19.-.20-21-22- The polling place for said precinct shall be at Residence, 440 J Street, Chula Vista. The officers of election for said precinct shall be as follows: INSPECTOR: Margaret A. Stahlheber JUDGE: Aletha C. O 'Laughlin CLERK: Margaret W. Cook CLERK: Myrtle C. Knight -5- Each qualified voter of the City of Chula Vista shall be entitled to vote only in the election precinct in which he resides. Section 3. Pursuant to the authorization of the Board of Supervisors of San Diego County, State of California, the Registrar of Voters of San Diego County, State of Cali- fornia, is hereby instructed, directed and authorized to conduct said election in accordance with law and in con- formity herewith and is directed to give notice of the holding of such election by publishing notice thereof at least ten days before the date of said election in the "Chula Vista Star, " which is a newspaper of general circula- tion, published in the City of Chula. Vista, and which is hereby designated by the City Council of the City of Chula Vista as th6 newspaper to be used for such publication. Said notice shall state the date of such election, the proposition to be submitted thereat, designate the election precincts, the places at which and the time during which the polls will be open for such election and the officers named as election officers . Said Registrar of Voters is also authorized and directed to make all arrangements for holding and conducting said election and such elec6ion shall be conducted and votes receiviad, the ballots counted and the returns canvassed, and the results thereof ascer- tained, determined and declared in the manner required by law for elections within said City of Chula Vista and as prescribed by said County Water Authority Act. Section 4. (a) The persons herein named as election officers are hereby appointed respectively to the position hereinabove designated. (b) The Registrar of Voters is hereby instructed, directed and authorized to distribute sample ballots and polling place cards by mailing same to the voters within the City of Chula Vista in the manner pres- cribed by law. Section 5. The canvassing of the vote of said election shall be made and conducted by the City Council of the City of Chula Vista at a meeting to be held for that purpose on Tuesday, the 29th day of April, 1952, at the hour of, 7:3O o 'clock P.M. , of said day at Council Chambers, in the City Hall, City of Chula Vista, County of San Diego, State of California; and if it be determined upon the canvassing of the votes cast at such election on the proposition so sub. mitted at said election to the electors of the City of Chula Vista that said proposition received the affirmative vote of the majority of the electors of said City of Chula voting on such proposition at said election, the City Council, through its mayor and city clerk, who are hereby authorized and directed to do and perform all such acts, shall certify the results of such election on such proposition to the Board of Directors 'of said South Bay Irrigation District and to the Board of Directors of said San Diego County Water Authority, together with legal descriptions of the boundaries of the cor- porate area of said City of Chula Vista, accompanied by, maps or plats, indicating such boundaries, and shall include in such certification a record of the proceedings by which said City of Chula Vista shall have withdrawn from said San Diego County Water Authority as a separate unit and shall promptly do all acts and take all proceedings required_ by law to be done or taken by, or on behalf of said City of Chula Vista to accomplish said withdrawal and to render said withdrawal fully effective for all purposes provided by law applicable hereto.
