RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA APPROVING AGREEMENT WITH'ARCHITECTS
FOR DESIGN OF SWIMMING POOL AND GYMNASIUM
THE CITY COUNCIL OF THE CITY OF CHULA VISTA, DOES HEREBY
RESOLVE AS FOLLOWS:
That certain agreement, dated the 10th day of March,
1953, between the CITY OF CHULA VISTA and JOHNSON, HATCH &
WULFF, a copy of which is attached hereto and by this
reference incorporated herein, is hereby approved, and the
Mayor of the City of Chula Vista is hereby authorized and
directed to execute the same for and on behalf of the City
of Chula Vista.
Said agreement is approved provided that, that certain
letter from Johnson, Hatch & Wulff, dated the 5th day of
March, 1953 which is also incorporated herein, is carried
out by Johnson, Hatch & Wulff, and the selection of Mr.
Ralph S. Brooks to act as suggested in said letter, is
approved. _

5. Payments. Payments to the Architect on account of his fee
• shall be made as follows, subject to -the provisions of Article 4:
Upon completion of the preliminary studies, a sum equal to 25%
• of the basic rate computed upon a reasonable estimate of cost
of the Recreational Unit to be designed under this contract.
Upon completion of the working drawings and specifications, a
sum sufficient to increase payments to 75% of the rate of
commission arising from this agreement computed upon a reasonable
cost estimated on such completed drawings and specifications, or
if bids have been received, then computed upon the lowest bona fide
•• bid or bids.
Upon completion of construction, a sum equal to the balance
of the commission arising from this agreement, computed upon
final cost of the work.
•
No deductions shall be made from the ArchitectTs fee on account
of penalty, liquidated damages, or other sums withheld from
payments to contractors.
• The Owner and the Architect hereby agree to the full performance of the cove-
nants contained herein.
IN WITNESS WHEREOF they have executed this agreement, the day and
year first above written.
