RECOMMENDATION: That Council approve the Ordinance. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: Chula Vista Ordinance No. 1801 relating to business licenses gives the City Council the authority to waive business license fees only when the major portion of the net revenues that are derived from the activity are to be used solely for charitable or benevolent purposes within the City, and not for the purpose of private gain of any individuals. Most of the organized City-wide events do not satisfy the above condition under which the City Council may waive business fees. The individual crafters and vendors are therefore subject to a $31 .50 business license fee if they are residents of Chula Vista ($25.00 business license plus $6.50 home occupation permit) and a fee of $50.00 if they are non-residents of Chula Vista. The problem has arisen that the above mentioned fees can act as a deterrent to arts and crafters wishing to participate in City events. This works contrary to the City objective of encouraging as much participation as possible in order to help promote and benefit the City and its community organizations. This issue was discussed by the City Council and staff at a conference meeting on April 25, 1985. The City Council expressed the desire to have the ability to waive business license fees for those events and organizations that help to promote and publicize the City of Chula Vista. With that in mind, the Ordinance before the City Council proposes to: 1 . Grant the Council authority to waive business license fees for those events and organizations that help to promote and publicize the City of Chula Vista. Implement a $5.00 temporary license fee for those events sponsored by a non-profit or charitable organization for which the City Council does not waive business license fees pursuant to No. 1 above. Participants will have the choice of obtaining a temporary license or an annual business license. Request for Waiver of Business License Fees At this time, the City has pending requests for waiver of business license fees from the Bonita Village Artists and the Chula Vista Art Guild. It would be appropriate for the Council to entertain these requests and any others at the City Council meeting of July 9 based on the following schedule: May 28 - First reading of Ordinance June 4 - Second reading and adoption of Ordinance July 5 - Effective date of Ordinance (31 days following adoption) July 9 - Council consider requests for waiver of business license fees The Bonita Village Artists and the Chula Vista Art Guild have been informed of the above schedule. FISCAL IMPACT: The City receives about $250,000 per year in business license revenues. Under current business license fee schedule, a waiver of fee results in a loss of $50.00 per non-resident participant and $31 .50 per resident participant if they do not already have a business license.
