This request is to bring into concert the grading and open space within a
recently recorded subdivision.
RECOMMENDATION: That Council accept the easement and authorize the Mayor to
sign grant.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
In May of 1980, the City Council approved the tentative map (Chula Vista Tract
80-5, El Rancho Del Rey) for a 365 lot subdivision located west of Paseo
Ladera and north of Telegraph Canyon Road.
The final grading for Unit 6C (involving 151 zero lot line lots) required the
raising of several lots to balance the earthwork. To avoid placing any fill
into the natural open space areas, the applicant moved the top of slope
towards the affected lots (see cross-section of typical lot).
On 39 lots (Reference 235-253 inclusive, lots 256-264 inclusive, and 266-276
inclusive) raising the grade caused the top of slope to be located
approximately two (2.0) feet into the rear of the recorded lots. The slope in
this area has been landscaped to match the rest of the slope and the
irrigation system was installed at the top of the raised slope. Fences will
be placed at the top of the slope rather than the rear property line.
The applicant is proposing that the City accept an open space easement which
would allow the installation and maintenance of lands/irrigation for this
small additional area in conjunction with the other open space slope banks
within the subdivision. The easement would prohibit the property owner from
erecting or maintaining any structure or walls, or to plant or grow materials,
change the grade, or install any private pipe without City permission.
The additional slope area will become the responsibility of the open space
district for this area. However, the added area will have literally no cost
effect because of the type of landscape and limited watering anticipated to
establish native plant growth.
FISCAL IMPACT: None.
