Luisi Resolution /2t2/'Approving Conditional Use Permit PCC-85-16, Establishing a cardroom at 838 Broadway in the C-T zone SUBMITTED BY: Director of Planning(0, REVIEWED BY: City Manager 9 (4/5ths Vote: Yes No X ) On April 9, 1985, the Council denied an application to establish a three-table (24 person) card room at 838 Broadway. In a motion that followed, Council then directed staff to look into the seating ratios for card rooms. (Reference preceding report on card rooms. ) On April 23, 1985, Mrs. Luisi (applicant for the card room) asked the Council to reconsider the application with a proposal to limit the card room to two tables and 16 people. The Council asked staff to reschedule the hearing in conjunction with the requested card room parking study. BOARDS/COMMISSIONS RECOMMENDATION: On 3/13/85 the Planning Commission denied a request to establish a three-table card room by a vote of 4-3. PLANNING DIRECTOR'S RECOMMENDATION: 1 . Find that this project will have no significant environmental impacts and adopt the Negative Declaration issued on IS-85-31 . 2. Based on findings contained in this report, adopt a motion to approve the request, PCC-85-16, to establish a cardroom at 838 Broadway in the C-T zone subject to the following conditions: a. The cardroom shall be limited to two tables and a maximum seating capacity of 16 persons (based on the availability of 10 off-street parking spaces to serve this use). b. The rear parking area shall be striped to accommodate 12 parking spaces, and a 6 ft. high block wall shall be constructed along the entire length of the rear property line. c. A plan for landscaping and illuminating the rear parking area shall be submitted for review and approval . The plan shall also indicate the location and design of the new trash enclosure. d. Any violation of these conditions shall be cause for review and possible revocation of PCC-85-16 by the Planning Commission. The subject property is a 50' x 183' parcel located on the west side of Broadway midway between "K" and "L" Streets. The site is developed with a single-story commercial structure which is divided into two 1 ,200 sq. ft. lease spaces. There are four parking spaces in front of the building, and a 20 ft. driveway shared with the property to the south leads to a paved but unstriped parking area in the rear. The southerly 1 ,200 sq. ft. of the building is occupied by a beer bar. Proposed use. The applicant proposes to establish the cardroom in the northerly 1 ,200 sq. ft. lease space previously occupied by a retail carpet store. There would be two tables with eight seats each, for a total seating capacity of 16. The proposal also includes adding landscaping and a trash enclosure in the rear, striping the rear parking area to accommodate 12 cars, and constructing a 6-foot-high block wall along the rear property line. Similar establishments. 1 . There are currently three cardrooms operating within the City. The number of cardrooms permitted by the Municipal Code (Section 5.20.30) is based on a ratio of one cardroom for each 25,000 persons or fraction thereof. Since the current estimate of population approximates 90,000 people, one additional cardroom may be authorized in the City. 2. The proposed use is governed by Chapter 5.20 of the Municipal Code, which in summary establishes the following regulations: a. No card games except draw poker, low-ball , and contract and auction bridge; b. Hours of operation, Monday through Saturday, between 10:00 a.m. and 12:00 midnight; c. No drinking of alcoholic beverages on the premises; d. Minimum age, 21 years; e. No more than eight tables and eight players to a table (maximum 64 persons); Page 3, Item 4 Meeting Date 5R1/85 f. The playing area of each table must be visible from outside the establ i shment; and g. The games must be supervised by the operator or employees of the establishment. ANALYSIS 1 . The Zoning Ordinance lists cardrooms as conditional uses in the C-C and C-T zones. 838 Broadway is in the C-T zone. 2. In previously approved requests for cardrooms, the Planning Commission has established a parking ratio of one space for each 2.5 seats. However, based on the Planning Department's most recent review of the City card rooms and their parking needs, it is recommended that ten spaces be allocated for the proposed 16 seat card room. When this figure is added to the six spaces. required to serve the 1 ,200 sq. ft. beer bar, then the total need is for 16 spaces, as shown by the applicant' s plan. 3. The proposed use conforms to the provisions of the Code governing such establishments. On the basis of experience with other cardrooms, the proposed use is not expected to generate noise or otherwise be objectionable to nearby businesses or residents. Nevertheless, the applicant will establish a 6-foot-high block wall along the rear property line in order to further ensure that adjacent residents are not disturbed. FINDINGS 1 . That the proposed use at the location is necessary or desirable to provide a service or facility which will contribute to the general well being of the neighborhood or the community. There are no other establishments of this type in the immediate area; the proposed use will offer a service to the residents not presently available. 2. That such use will not under the circumstances of the particular case, be detrimental to the health, safety or general welfare of persons residing or working in the vicinity or injurious to property or improvements in the vicinity. The use will be located in a thoroughfare commercial district, with ten parking spaces provided and will be buffered from adjacent residents by a 6-foot-high zoning wall ; the nature of the use and proposed method of operation should not have an adverse effect on the adjoining uses. 3. That the proposed use will comply with the regulations and conditions specified in the code for such use. The proposed use meets the regulations established by Chapter 5.20 of the Municipal Code. Page 4, Item 4 Meeting Date 5/21/85 4. That the granting of this conditional use permit will not adversely affect the general plan of the City or the adopted plan of any government agency. The property is designated for thoroughfare commercial use on the General Plan. The proposed use is in keeping with this designation. FISCAL IMPACT: Not applicable. WPC 1823P O COUNCIL AGENDA STATEMENT Item 4 Meeting Date 5/21/85 ITEM TITLE: Report: Card room parking requirements SUBMITTED BY: Director of Planning G REVIEWED BY: City Manager (4/5ths Vote: Yes No x ) After denying a Conditional Use Permit for a card room at 838 Broadway on April 9, 1985, Council requested that staff look into the seating ratios required of other jurisdictions and report back to the Council . At a later Council meeting, the applicant for the card room at 838 Broadway asked for new hearing based on a reduction of tables. Council directed staff to set the matter for rehearing concurrent with the parking report, therefore, the rehearing for 838 Broadway will follow this report. RECOMMENDATION: Accept report and refer findings to the Planning Commission for future considerations of card room applications. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable at this time. DISCUSSION: Based on the Council 's directive, the following agencies were checked for card room standards: Agency Ratio Carlsbad 1 sp/5 seats City of El Cajon 1 sp/5 seats City of Imperial Beach No standards yet City of La Mesa 1 sp/4 seats City of of San Diego 1 sp/3 seats County of San Diego 1 sp/3 seats Gardenia 1 sp/3 seats Lake Elsinore 1 sp/3 seats The typical ratio established by the agencies checked varied from 1 per 3 seats to 1 per 5 seats. None of the agencies contacted indicated problems due to insufficient parking. Chula Vista has required 1 space per 2-1/2 seats for card rooms utilizing the Conditional Use Permit Procedure with one card room allowed per 25,000 population. r i/ / t _� Page 2, Item 4 Meeting Date 5/?1/85 The three existing City card rooms were checked on both a Friday and Saturday night at their reported peak time, 7:00-9:00 p.m. , which resulted in the average number of cars per seat equal to 1 .4. The average was very consistent for the three clubs checked. Thus, staff has concluded that a successful club operating at capacity should be required to provide approximately one parking space for every 1-1/2 seats authorized. FISCAL IMPACT: WPC 1935P \.)--61
