The improvement agreement was approved by City Council Resolution 10661 dated October 6, 1981 . RECOMMENDATION: That Council approve resolution accepting the onsite public improvements. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: Pacific Scene, Inc. requested a final inspection of public improvements which was made on January 26, 1984. A letter of deficiencies was prepared on February 1 , 1984. Pacific Scene, Inc. has now completed the corrections. A review inspection was made on April 26, 1985, and all work was found to be completed in accordance with the plans and to the satisfaction of the City Engineer. Pacific Scene, Inc. has submitted a maintenance bond in the amount of $131 ,400.00 to guarantee the improvements as to workmanship and material , for a period of one year after acceptance by the City Council . Pacific Scene, Inc. , through approval of Charter Point Unit #1 Subdivision, was required to improve Telegraph Canyon Road from Otay Lakes Road to approximately 650 feet west of Apache Drive, Resolution 10276. Condition 17 of the approval required construction to be performed prior to occupancy of 104 units in Charter Point #1 or within five years after approval of the Final Map for Unit #1. The Final Map was approved on October 14, 1981 . Subsequent modifications to the original agreement now requires construction of Telegraph Canyon Road when a total occupancy of 220 units occurs for Charter Point 1 , 2, and 3. As of larch 27, 1985, 220 units not including 12 model units, have been finaled by the Building ')epartment. Of these, 206 units are occupied. Pacific Scene, Inc. presently has on deposit a "pledge of money" in the amount of $800,000.00 at Great American Federal , Account No. 000-318-6137. In addition, the City has on file a bond from American Insurance Co. in the amount of $800,000.00, Bond No. 731-13-72. The City, therefore, has surety in a total aggregate of $1 ,600,000.00 to guarantee the required construction of Telegraph Canyon Road. 11 Page 2, Item Meeting Date 5/7/85 City Council Resolution 11818 specifies the improvements to be constructed and directs the City Engineer to implement their construction at an appropriate time. Approval of this resolution accepting the onsite public improvements will not affect the agreement for constructing Telegraph Canyon Road public improvements between Otay Lakes Road to 650+ feet west of Apache Drive.
